جایگاه سنت حاکی از داوری یا نحوه اجرای حکم در تشریع

سنت به معنای قول و فعل و تقریر معصوم، پس از قرآن که ماخذ اصلی استنباط احکام شرعی است، منبع مهم محسوب می ‌شود و اخبارِ حاکی از سنت وقتی متضمن بیان حکمی باشد نزد فقها دلیل حکم محسوب می‌ شود و در اصطلاح فقهی می ‌گویند از چنین سنتی تشریع استفاده می ‌شود، ولی گاه سنت از پیاده کردن حکم در حوزه قضاء، اجرا و تعیین مصداق به وسیله معصوم حکایت دارد و لذا فقها چنین اخباری را بدون آنکه در صدور آنها تردید نمایند، مستند حکم قرار نمی‌ دهند و آن را به عنوان «قضیه فی واقعه» تلقی می‌ کنند. اکنون این سوال مطرح است که آیا می‌ توان رویه یا قاعده‌ ای را یافت تا این ‌گونه روایات را از روایات متضمن حکم کلی متمایز ساخت؟ اگر بتوان چنین قاعده‌ ای از مجموع روایات اصطیاد نمود تحول قابل توجهی در استنباط احکام به وجود خواهد آمد. در این نوشتار، نویسنده ضوابطی جهت تمییز اخبار متضمن تشریع از اخبارِ حاکی از اجرای حکم یادآوری به دست داده است.

The Status of Traditions Representing Judgment or Traditions Representing the Way of Execution in Legislation

Tradition (Sunnat) refers to the deeds, sayings and permissions (or disapprovals) of Infallibles (pbut) which are the essential sources of understanding the decrees after The Holy Quran. When Quotes which convey Tradition (Sunnat) include a decree or law, they are considered as a reason for jurisprudents, and in jurisprudential term, they say that the Tradition (Sunnat) can be used for legislation. However, sometimes, Tradition (Sunnat) narrates the execution of a law or decree by the infallibles (pbut). In these cases, jurisprudents do not consider it for legislation. Now the question will come up: “Is there a rule for recognizing these two types of quotations?” If it is possible to extract such a rule out of the sayings and quotations, there will be a revolutionary change in understanding decrees. In this article the author sets a framework to distinguish traditions representing judgment or traditions representing the way of execution in legislation.
