عوامل تحقّق احساس مطلوب شهروندان نسبت به عدالت کیفری

درک و احساس مناسب از عدالت کیفری نزد شهروندان ازجمله مسائل مهم اجتماعی است که تحقّق آن در گرو فراهم‌آمدن شاخصه‌های عدالت کیفری در فرایندهای جزایی از یک سو و برخورداری جامعه و افراد از زمینه‌های احساسی و شناختی مناسب از سوی دیگر است. استنتاج معیارهای عدالت کیفری مطلوب حاصل سال‌ها تجربه و تامل است که در رویکردهایی نظیر «رویکرد ترمیمی» انعکاس یافته است. بررسی عوامل و زمینه‌های درک این معیارها از سوی شهروندان از راه یافته‌ها در منابع جامعه‌شناختی و روان‌شناختی و با الهام از متون دینی موضوع این تحقیق است. حاصل این بررسی آن است که در صورت تحقّق عینی معیارهای عدالت کیفری در نظام جزایی، ادراک و احساس مطلوب از عدالت کیفری برای شهروندان تنها زمانی تحقّق می‌یابد که ایشان علاوه بر آگاهی و باور نسبت به معیارهای عدالت کیفری در رشد عاطفی و برخورداری از عدالت اجتماعی دچار آسیب نبوده و در برآورده‌شدن «نیازهای پایه زندگی» خود که به‌ لحاظ رتبی بر «نیاز عدالت» تقدم دارد، دچار مشکل نباشند. این همه در کنار نظم دیوان‌سالاری در نظام اداری کشور و اطلاع‌رسانی دقیق، شفاف و صادقانه از فرایندهای کیفری در نظام قضایی می‌تواند زمینه‌های مناسب برای ادراک و احساس مطلوب شهروندان از عدالت کیفری در جامعه در حال زیست خود را فراهم آورد.

Factors for Realization of Ideal Feeling of Citizens toward Criminal Justice

The proper understanding and feeling of criminal justice is one of the important social issues for citizens, which its realization depends on the provision of criminal justice indicators in criminal processes on the one hand, and the society and individuals having appropriate emotional and cognitive backgrounds on the other hand. Deducing the ideal criminal justice criteria is the result of years of experience and reflection, which is reflected in approaches such as restorative approach. Examining the factors and contexts of citizens’ understanding of these criteria through findings in sociological and psychological sources and inspired by religious texts is the subject of this study. The findings of this study suggest that if the criteria of criminal justice are objectively achieved in the penal system, the perception and favorable feeling of criminal justice for the citizens will be achieved only when they, in addition to awareness and believing in the criteria of criminal justice, shouldn’t be vulnerable to have emotional growth and enjoyment of social justice and should not have any problems in meeting their basic needs of life which are ranked ahead of needs of justice. All these factors, along with the bureaucratic order in the country’s administrative system and accurate, transparent, and honest information about criminal processes in the judicial system, can provide suitable contexts for the citizens’ perception and ideal feeling of criminal justice in their current society.
