داد و دادورزی در فرمان های شاهان هخامنشی و تاثیر آن بر تامین نظم و امنیت

هخامنشیان بیش از هر امر دیگری در مقوله عدالت‌ورزی و اجرای آن که انضباط اجتماعی را به همراه دارد، صاحب دغدغه بودند و می کوشیدند با در نظر گرفتن نقش دولت، عدالتی فراتر از بعد فردی آن در ابعاد اجتماعی مورد مداقه قرار گیرد. با در نظر گرفتن نسبت و پیوند وثیق دادورزی با نظم و امنیت، پژوهش حاضر در پی پاسخ به این پرسش است که چگونه تدوین قانون و دادورزی پادشاهان هخامنشی بر انتظام اجتماعی تاثیر گذاشته است؟ روش پژوهش مقاله، توصیفی– تحلیلی بر پایه مطالعه اسنادی کتابخانه‌ای است و هدف از انجام این پژوهش تبیین تاثیر قوانین حقوقی وضع شده و دادورزی پادشاهان در تامین نظم و امنیت ایران عصر هخامنشی است. یافته‌ها بر آن است که بسیاری از فرمان های شاهان هخامنشی با درون‌مایه‌ حقوقی و مشتمل بر دو نوع قانون الهی و قانون شاهی وضع شده است و یکی از دلایل صدور این قوانین و دادورزی پادشاهان هخامنشی، تامین نظم و امنیت و اجرای آن در کشور است. همچنین نتایج این پژوهش، وضع قوانین توسط پادشاهان هخامنشی را متاثر از دین می‌داند که هدف از اجرای آن و تاکید پادشاهان بر دادورزی، ایجاد حکومتی است که قلمروی آن خرد، راستی و خیر است و دادورزی، انتظام شهر و کشور را به ارمغان می‌آورد تا مردمان در پناه قوانین وضع شده بتوانند در آرامش و امنیت زندگی کنند و مظاهر زندگی مادی را گسترش دهند و جلوه این قوانین می بایست گسترش قانون در جهان و رفاه و بهروزی ناشی از آن باشد.

Justice in the decrees of the Achaemenid kings and its effect on ensuring order and security

The Achaemenids were more concerned with justice and its implementation than anything else, which entails social discipline,and sought to consider justice beyond its individual dimension in the social dimension, given the role of the state.Considering the close relationship between justice, order and security, the present study seeks to answer the question that how the formulation of law and justice of the Achaemenid kings affected social order? The research method is descriptiveanalytical based on a documentarylibrary study and the purpose of this research is to explain the effect of legal laws and the justice of kings in ensuring order and security in Achaemenid period. The findings show that many of the decrees of the Achaemenid kings were issued with a legal theme and included two types of divine law and royal law. One reason to issue these orders and the justice of the Achaemenid kings is to ensure order and security in the country. The results of this study also consider the influence of religion on the enactment of laws by the Achaemenid kings.The purpose of its implementation and the emphasis of the kings on justice is to create a government whose domain is wisdom, truth and goodness and justice brings order to the city and country. People can live in peace and security under the laws, and expand the manifestations of material life, and the manifestation of these laws must be the spread of law in the world and the prosperity and wellbeing that comes with it.
