feasibility study of the rule of permissibility of good things and prohibition of impure things in islamic jurisprudence

Authors hal atai mahmoud
Abstract    the principle of permitting of ṭayyibāt (permissible things) and the prohibition of khabāʾith (forbidden things) has been extensively referenced in islamic jurisprudential sources. however، substantial questions exist regarding its underlying reality. the primary issue concerns whether permitting of ṭayyibāt and the prohibition of khabāʾith possess a constitutive aspect such that it can be used to derive rulings for new issues. a significant number of jurists (fuqahā) believe in its applicability، referring to it as a legal principle and asserting that it is even among the necessities of the faith and religion. they rely on verses from the qurʾan and prophetic traditions (ahādīth) to validate its authority. alternatively، another view posits that permitting of ṭayyibāt and the prohibition of khabāʾith represents the intrinsic reality of the islamic legal framework، with its rulings based on criteria such as what is ṭayyib and what is khabīth. however، this does not imply that individuals (mukallafīn) are capable of discerning specific instances accurately. this study، which adopts a descriptive-analytical approach based on library resources، aims to analyze these perspectives and their supporting arguments while investigating the implications of this principle، its applications، the obligations during uncertainty (shakk)، and the validity of its sources. the conclusion drawn is that the principle of the permissibility (ḥilliyya) of ṭayyibāt and the prohibition (ḥurma) of khabāʾith is not fully established as a comprehensive qāʿida fiqhiyya (legal principle). deducing specific aḥkām fiqhiyya (legal rulings) based on the qualities of being ṭayyib (pure، good) or khabāʾith (impure، bad) falls within the purview of the sacred lawgiver (shāriʿ muqaddas)، and none other is qualified for this significant task.
