legal and jurisprudential applications of the rule of ghurūr (deception) in marital relations

Abstract    the necessity of compensating the deceived party and restoring them to their previous condition is one of the most important reasons for the establishment of the rule of ghurūr (deception) in islamic law. the application of this rule in the marriage contract (ʿaqd al-nikāḥ) differs significantly due to its fundamental distinctions from other contracts. modern advancements in life have introduced new dimensions of deception، such as transferring assets to relatives to avoid paying the dowry (mahr) or feigning infertility، which cannot be directly addressed within traditional jurisprudence (fiqh). from an islamic perspective، the importance of preserving the family foundation necessitates a new approach to the rule of ghurūr، focusing on the element of deception. this study argues that a precise distinction between tadlīs (fraudulent misrepresentation) and ghurūr allows for a redefinition of the element of deception. judicial rulings indicate that new methods of deception in marital life، aimed at evading legal obligations، have not been adequately addressed.
Keywords ghurūr (deception) ,nikāḥ (marriage) ,tadlīs (fraudulent misrepresentation) ,aṣl al-ṣiḥḥa (principle of validity) ,marital life
