احکام آبادانی زمین با رویکرد ساخت‌وساز مسکن

مطلوب پروردگار برای آدمی، آبادانی زمین و بهره‌برداری از خیرات و برکات آن است. طلب عمران زمین از جانب مولابه بندگان صادر شده است که دال بر مطلوبیت آبادانی نزد مولا و وجوب کفایی آن است. به نظر می‌رسد که این آبادانی، با استقرار در زمین و برنامه‌ریزی برای سکونت در آن شکل می‌گیرد. اما سوال این است: حکم اولی آبادانی و ساخت‌وساز مسکن چیست؟ چه دلایلی بر آن قائم است؟ کاربری مسکونی به دلیل آیات کریمه در برخی شرایط وجوب و در برخی شرایط احکام تکلیفی دیگری را بر می‌تابد. از مجموع روایات مانند احیای موات، بنای حائط، کاروانسرا و... نیز حکم اولی ساخت وساز، جواز برداشت می‌شود، اما به دلیل سیره عقلا و قواعد فقهیۀ حفظ نظام، لاضرر، عمران و تامین رفاه، ساختن مسکن در حد کفایت و مطلوب واجب است. برای به دست آوردن یافته‌های پژوهش که با رویکرد توصیفی، تحلیلی حاصل‌شده است ازمنابع و قواعدفقهی و نیز سیره عقلا بهره جسته شده است.
