بررسی تضاد قاعده فقهی«نفی سبیل» با نظریه جهانی‌شدن و جهانی‌سازی

جهانی شدن و جهانی‌سازی از مفاهیمی است که در دهه پایانی قرن بیستم تاثیر عمیقی بر بسیاری از جریانات سیاسی، فرهنگی، ‌اجتماعی و اقتصادی داشته است. جهانی شدن بیانگر نوعی جهان‌بینی و اندیشیدن درباره جهان به ‌عنوان یک منظومه کلان و به هم پیوسته است که می‌تواند چارچوب مفهومی برای تبیین واقعیت‌های جاری جهان باشد. جهانی‌ سازی نیز مفهومی همسو و مرتبط با جهانی شدن است. با این که در اسلام آموزه‌های نظیر دعوت و تبلیغ جهانی و خلافت فراگیر اسلامی وجود دارد که بیانگر جهانی بودن آن است، اما با نظریه متداول جهانی‌شدن و جهانی‌سازی در تضاد است. در این پژوهش نشان داده خواهد شد که نظریه جهانی شدن با قاعده فقهی «نفی سبیل» در تضاد است. قاعده نفی سبیل که به طور مشخص تن دادن به جهانی سازی و جهانی شدن را به نوعی مقدمه ایجاد سبیل و سلطه می‌داند. بررسی این قاعده فقهی و تضاد آن با جهانی سازی، محور بحث این نوشتار به روش توصیفی تحلیلی است.

the study of the contradiction between the jurisprudential rule of nafye sabil with the theory of globalism and globalization

globalization is one of the concepts that has had a profound impact on many political, cultural, social and economic currents in the last decade of the twentieth century. globalization expresses a kind of worldview and thinking about the world as a macro and interconnected system that can be a conceptual framework for explaining the current realities of the world. globalization is also a concept related to globalization. although there are teachings in islam such as universal invitation and propagation and an all encompassing islamic caliphate that indicate its universality, it contradicts the common theory of globalism and globalization. in this research, it will be shown that the theory of globalization is in contradiction with the jurisprudential rule of &nafye sabil” (denying the path). this rule explicitly considers submission to globalism and globalization as a kind of prelude to path and domination. the study of this jurisprudential rule and its contradiction with globalization is the focus of this article in a descriptive analytical method.
