پدیدارشناسی «وقف در گردش» بر اساس فقه استدلالی امامیه

یکی از مباحث عمده در مورد وقف، تقسیماتی است که در مورد آن صورت می‌گیرد و هریک ناظر به جهت ویژه‌ای از وقف است و احکام و آثار خاصی را در مورد انواع وقف بیان می‌دارد. از جمله و در مشهورترین تقسیم، وقف را بر مبنای نیّت و اراده واقف در هنگام انشای صیغه وقف و تعیین یا عدم تعیین موقوف‌علیهم، به دو نوع «وقف عام» و «وقف خاص» منقسم ساخته‌اند.با این حال، تقسیم‌بندی جدیدی از وقف را نیز می‌توان تصور نمود که بر مبنای ویژگی‌های مال موقوفه صورت می‌گیرد و در آن، امکان یا عدم امکان انتفاع همزمان موقوف‌علیهم، معیار دسته‌بندی قرار می‌گیرد. بر این اساس، وقف ‌به موجب اصطلاحات نوینی که در این پژوهش برای آن انتخاب شده‌ به دو نوع «وقف ثابت» و «وقف در گردش» تقسیم می‌گردد که پژوهش فرارو به عنوان نخستین اثر تحقیقی در این زمینه‌ در روشی توصیفی‌‌تحلیلی به بررسی آن می‌پردازد. هدف از این پژوهش، معرفی و تحلیل نظری این نوع از وقف بر مبنای آرای استدلالی فقه امامیه بوده و ضرورت آن، شناسایی نوع جدیدی از موقوفات است که از حیث احکام و آثار با انواع دیگر وقف تفاوت دارد. در وقف در گردش، مال وقفی به صورت ترتیبی در اختیار موقوف‌علیهم قرار می گیرد و آنان به صورت دَوَرانی و گردشی، از موقوفه بهره‌مند می‌شوند و هر منتفع پس از انتفاع، آن را در اختیار فرد دیگر قرار می دهد. نتایج پژوهش، از شمول ادله مشروعیت وقف نسبت به این نوع جدید و وجود شرایط صحت در آن حکایت دارد.

phenomenology of endowment in circulation based on imamiyah jurisprudence

one of the main issues about waqf (endowment) is the divisions that are made about it and each of them observes a specific aspect of it and expresses certain rules and effects about different types of it. for example, the waqf has been divided into two types of &general waqf& and &special waqf& based on the intention of the endower and determining or not determining the beneficiaries of waqf.however, a new division of the endowment can also be imagined, which is based on the characteristics of the endowment property, in which the possibility or impossibility of simultaneous use of the beneficiaries is the criterion of classification. accordingly, endowment is divided into two types of &fixed endowment& and &circulating endowment& that this research as the first research work in this background examines it in a descriptive analytical way. the purpose of this study is to introduce and theoretically analyze this type of endowment based on the reasoning views of imamiyah jurisprudence and its necessity is to identify a new type of endowment that differs from other types of endowment. in the case of a circulating endowment, the endowment property is given to the beneficiaries of waqf in a sequential manner, and they benefit from the endowment in a rotating manner, and each beneficiary, after the use, gives it to the other person. the results of the research indicate that the reasons for the legitimacy of the waqf include this new type and the conditions for its validity exist.
