بررسی احکام شهرسازی با رویکرد کاربری مسکونی

الزامات نظام برنامه‌ریزی و طراحی کاربری‌ها در شهرسازی می‌تواند تابع احکام و قواعد فقهی باشد. از آنجا که حوزه شهرسازی وسیع بوده و تحقیق گسترده‌ای را می‌طلبد، در این پژوهش، فقط به حوزه کاربری یعنی تعیین نحوه استفاده از زمین در حوزه کاربری مسکونی پرداخته ‌شده است. در این راستا علاوه بر بهره‌مندی از آیات قرآن، از روایات و سنت پیامبر گرامی اسلام و اهل ‌بیت ع نیز بهره گرفته شده است. جستار حاضر می‌کوشد به این سوال پاسخ دهد که آیا احکام فقهی از بُعد برنامه‌ریزی کاربری مسکونی بر شهرسازی تاثیری دارد؟ میزان و محل استقرار کاربری‌ مسکونی از جهت سازگاری و وابستگی و ظرفیت می‌تواند تحت تاثیر احکام فقهی شکل بگیرد. همچنین تطابق با ویژگی‌های اجتماعی فضای شهری، افزایش‌ یافته و بر این اساس سطح تعاملات اجتماعی که ناشی از  باورهای دینی شهروندان است، ارتقاء یابد. در شهری که بر اساس احکام فقهی برپا شود ایجاد نگرشی صحیح و رویکردی جدید به شهرسازی حاصل‌شده و نیز توسعه و نشر قوانین شهری با توجه به دستورات دین مبین اسلام انجام می‌گیرد. در آن صورت، شهروندان می‌توانند واجبات خود را به راحتی انجام و از محرمات دوری کنند.

The study of the rules of urban planning with a residential use approach

The requirements of the planning system and design of land uses in urban planning can be subject to jurisprudential rules and regulations. Since the field of urban planning is large and requires extensive research, only the field of use, i.e. determining how to use land in the field of residential use has been addressed in this research. In this regard, in addition to benefiting from the verses of the Qur’an, the narrations and tradition of the Holy Prophet of Islam (PBUH) and the Ahl alBayt (AS) have also been used. The present article tries to answer the question whether jurisprudential rules have an impact on urban planning in terms of residential use planning? The amount and location of residential use in terms of compatibility and dependence and capacity can be formed under the influence of jurisprudential rules. Also, adaptation to the social characteristics of the urban space to be increased, and accordingly, the level of social interactions that results from the religious beliefs of the citizens to be improved. In a city that is established according to the rules of jurisprudence, creating a correct attitude and a new approach to urban planning is achieved, as well as the development and publication of urban laws according to the instructions of the religion of Islam. In that case, the citizens can easily perform their duties and avoid the prohibitions
