ویژگی‌های مشرب فقهی کاشف الغطاء

هر یک از فقیهان امامیه در تاریخ فقه و فقاهت شیعی دارای نقش بده اند، اما بعضی از آنان به دلیل برجستگی در یک یا چند بعد نقش چشمگیری ایفا کرده اند. علامه شیخ محمد حسین کاشف الغطاء از فقیهانی است که به دلیل برخورداری از ویژگی های متعدد، در تاریخ عصر اخیر در جهان اسلام درخشید. شناسایی ویژگی های او در عرصه فقاهت و تبیین هر کدام با استناد به آثار و تالیفات وی موضوع این مقاله است. «دفاع از مبانی و احکام شریعت»، «باور به توانایی فقیه حاذق در کشف ملاکات احکام»، «توجه به عناصر زمان و مکان در اجتهاد»، «نگاه اجتماعی در فقه»، «شجاعت در نقد و حریّت در رای»، «دفاع مستند از فقه امامیه»، «توجه به روح و باطن احکام»، و بالاخره «تفکیک جایگاه عرف از جایگاه شرع» از جمله ویژگی های فقه کاشف الغطاست. مجموعه این ویژگی ها به علاوه «برخورداری از روح تعامل با دانشمندان فرق، مذاهب و ادیان دیگر» و «حضور مستمرّ در عرصه اجتماع و سیاست» او را از فقیهان معاصرش ممتاز ساخته و عنصری تاثیرگذار در امت اسلامی و حتی پیروان ادیان دیگر گردانید.

The characteristics of the jurisprudential attitude of Kashif AlGhita

Each one of the Shiite jurists have played a role in the history of jurisprudence, but some of them due to outstanding in some aspects have played more important roles. Allamah Shaikh Muhammad Hussain Kashif AlGhita is one of the jurists that due to their several characteristics have shined in the last period of history of the Islamic world. Introducing his characteristics in the field of jurisprudence and explaining them with reference to his works is the subject matter of the paper. Defending the bases and canons of Sharia, believing in the ability of the skilled jurist to elicit the criterions of the canons, considering the factors of time and place in Ijtihad, having a social attitude in jurisprudence, courageousness in critique and liberty in idea, reasonable defending of Imamiah jurisprudence, considering the soul and inside of canons and finally separating the position of costume from the that of Sharia are some of the characteristics of his jurisprudence. These characteristics in addition to enjoying the mentality of cooperation with the scholars of other sects, schools and religions and the continuous presence in the society and politics have distinguished him from other contemporaneous jurists and introduces him as an effective figure in the Islamic Ummah and even among the followers of other religions.
