بازپژوهی مشروعیت قراردادهای نوپدید با تاکید بر آیه شریفه «اوفوا بالعقود

با پیچیده تر شدن و گسترش روابط انسان ها، عقود و قراردادهای نوینی پدید می آیند که ارتباطات بشر را زیر سلطة خود قرار می دهند. پرداختن به عقود نوظهور از مباحث مهم فقه و حقوق اسهلامی به شمار می رود که در حقوق، با عنوان اص حاکمیت اراده از آن یاد می شود و مادة 68 قانون مدنی جمهوری اسلامی ایران نیز به آن اشاره دارد و ازایهن رو، اثبهات قراردادهای نوظهور و دم انحصار آن ها در عقود زمان شارع، اهمیت فراوانی می یابد. از مهم ترین دلایلی که برای عدم انحصار شرعی عقود بیان شده، آیه شریفه یَا اَیُّهَا الَّذِینَ آمَنُواْ اَوْفُواْ بِالْعُقُودِ است. در این نوشتار که به شیوه توصیفی - تحلیلی و استفاده از منابع کتابخانه ای نوشته شده، به بررسی نحوه دلالت آیه مذکور بر منحصر نبودن عقود در زمان شارع و نیز اشکالات مطرح پیرامون آن پرداخته است و بیان شده که آیه شریفه به طور کام بر عدم انحصار عقود شرعی و شمول واژه العقود بر عقود نوپدید دلالت دارد.

Investigation of the legitimacy of new contracts with an emphasis on the verse "The Voice of God

Amineh Vadud is a new Muslim feminism who tries to have an approach of reinterpretationing the Qur’an based on a hermeneutical method adapted from the monotheistic hermeneutics and the dual movement theory of Fazl alRahman Of the important feature of this method is attending to the historical background of text appearance, the language capabilities of the revelation language and considering the reader’s mentality and simultaneous rolling of the text and reader. Vadud tries to run the hermeneutical style of the Fazl alRahman as an example of some of the verses of the Quran that relate to the women’s field and survey the verses of the Quran with a complete feminine view. Vadud is actually seeking a feminine commentary from the Quran but her commentary does not differ much from Fazl alRahman interpretations.Researchers in this article, on the basis of a descriptiveanalytical method, critiques and examines the influence of the monotheistic hermeneutics of Fazel alRamahan, and in particular his dual movement theory have been based on Amineh Vadud’s views in his famous book entitled The Qur’an and woman. The general achievement of this study , express that Amine Vadud, contrary to her claim, did not have any interpretive and feminine inventions in relation to Fazl alArhoman.In fact, she has become more and more in the form of a highranking embroidery and, in analyzing and verbalizing the Qur’anic verses,does not have enough precision.
