ارزیابی ضوابط اجرایی روش طرح و ساخت صنعتی کشور ایران (مطالعه موردی قراردادهای صنعت نفت)

ایران دارای رتبه نخست ذخایر گازی و سومین مالک بزرگ ذخایر نفتی در جهان است؛ لذا اجرای پروژه ها در این صنعت عظیم، نیازمند قراردادهای دقیقی است. در راستای انجام بهینه پروژه های طرح و ساخت صنعتی، تدوین الگو و مختصات جدید سند همسان طرح و ساخت با کمترین ایرادات، امری اجتناب ناپذیر است؛ به نحوی که با قطعیت دادن به زمان و مبلغ مندرج در قرارداد تا حد امکان، با بهترین کیفیت و کمترین میزان دعاوی، نتایج مطلوب حاصل و پروژه ها با بهترین کیفیت اجرا گردند. در این راستا با انجام مطالعات کتابخانه ای، بررسی اسناد بین المللی خصوصا سند نقره ای فیدیک، مطالعه مقالات و پایان نامه ها و بررسی قوانین و مقررات، ایرادات و کاستی های موجود با طراحی، توزیع و جمع آوری پرسشنامه از خبرگان و تحلیل نتایج مشخص گردیده و این نتایج حاصل شد که علاوه بر اصلاح ساختار و مدل مفهومی سند، بایستی تعهدات و مسئولیت های طرفین پیمان بطور دقیق پیش بینی شده و توزیع منطقی ریسک انجام شود. خصوصا در زمینه تاخیر در پرداخت به پیمانکاران، مکانیزم جبران خسارات پیش بینی گردد. همچنین ماده های مربوط به مبلغ پیمان، شرایط تنفیذ پیمان، انجام طراحی پایه، بیمه نامه ها، ضمانتنامه ها، تسهیلات پیمانکاران، تعلیق، تحویل موقت و خاتمه و فسخ پیمان و سایر موارد اصلاح گردیده و قوانینی که باید صراحتا در متن شرایط عمومی پیمان عنوان گردند، ذکر شوند.

Assessment of Iran Industrial Design-Build Method (Case Study of Oil Industry Contracts)

Iran holds the first and third rank worldwide in gas and oil reservoirs, respectively; therefore, projects executed in this noble industry requires accurate contracts.In order to optimize accomplishment of industrial designbuild projects, designing new coordinates of EPC identical documents with the least potential problems is inevitable, In a way that, with certifying the time and fee stated in the contract to the most possible extent, with the highest quality and fewest claims, the desired results be obtained and the project be fulfilled with the best quality. To this end, with the pursuit of library based studies, investigating international documents particularly FIDIC silver book, reviewing articles, theses, rules and regulations, existing problems and deficiencies have been identified through designing, distributing, and collecting a survey from the elites after having the obtained results analyzed and thus this conclusion has been drawn that, in addition to reforming the structure and conceptual model of the document, it is also required that the obligations and liabilities of both parties of the contract be minutely specified and the logical distribution of the risk be conducted. Especially, in the area of delay in payment to the contractors, the mechanism required for compensating the loss needs to be anticipated. moreover, the articles related to contract price, commencement date conditions, basic design, assurance, guaranty letters, contractors facilities, suspension, provisional taking over, termination, waiver and other cases need to be corrected and the rules that are required to be expressly mentioned in the context of general conditions of the contract be stated.
