تعدیل در قراردادهای اداری

تعدیل در قرارداد یکی از موضوعات مهم و بحث‌انگیز قواعد عمومی قراردادهاست که در حقوق اداری برخی کشورها، به‌ویژه فرانسه، در قراردادهای اداری، برخلاف قراردادهای خصوصی، به علت طولانی‌مدت بودن این نوع قراردادها و شرایط خاص انعقاد آن‌ها و به منظور تامین منافع عمومی پیش‌بینی شده است. اما در نظام حقوقی ایران جز در موارد اندک و استثنایی مورد پذیرش قرار نگرفته است. یکی از این موارد، پیش‌بینی تعدیل بهای پیمان در قراردادهای پیمانکاری دولتی به صورت قراردادی و قانونی است. پیش‌بینی تعدیل در این نوع قراردادها با توجه به فقدان نظام جامع قراردادهای اداری در حقوق اداری ایران و نامشخص بودن جایگاه عامل اصلی پیدایش تعدیل در قراردادهای اداری، یعنی نظریۀ امور غیرقابل پیش‌بینی در این نظام حقوقی، بحث ‌انگیزتر است که ابعاد آن در این مقاله بررسی می‌شود.

Adjustment in administrative contracts

Adjustment in contract is one of the most important and controversial issues in general rules of contracts in administrative law of some countries like France. It is anticipated in administrative contracts, against private contracts, to ensure the public interests due to the long duration and special conditions of these contracts. But in legal system of Iran, it has been accepted just in rare and exceptional cases. One of these cases is clauses of contractual price adjustment in public construction contracts. However, in administrative law in Iran, anticipation of adjustment in this kind of contracts is more controversial due to lack of a comprehensive system of administrative contracts and unknown factor of appearance of adjustment in administrative contracts i.e. “theory of unforeseeable affairsquot;. Legal aspects of this issue will be studied in this article
