احترام به قانون در اندیشه افلاطون

یکی از مسائل اساسی در فلسفه حقوق، «احترام به قانون» است؛ یعنی به چه ترتیب می‌توان در شرایط عادی اطاعت از قانون را توجیه کرد؟ یا برعکس، آیا شرایطی وجود دارد که نافرمانی از قانون از لحاظ اخلاقی موجه باشد؟ برداشت عموم از دیدگاه افلاطون دربردارنده توجیه مقتدرانه و اطاعت بدون قید و شرط از قانون است، که فاقد مبنای عقلانی است. در نوشتار حاضر، ضمن نقد تفاسیر اقتدارگرایانه، اقتدار قانون از دیدگاه فضیلت اخلاقی بررسی می‌‌شود. در این دیدگاه، دلیل احترام شهروندان به قانون کسب فضایل اخلاقی است. در جایی که معلوم شود امکان ایجاد تعامل و برقراری گفت‌وگو، به منزله پیش‌شرط فضلیت اخلاقی، میان قانون‌گذاران و شهروندان وجود ندارد، گزینه نافرمانی از قانون مطرح می‌شود.

Respect to law in Plato's idea

One central issue in philosophy of law is quot;respect to lawquot;: what arguments can be given, under normal circumstances, to justify obeying the law and conversely, are there any circumstances under which we are morally justified in disobeying? Typically, reading of Plato’s views includes an authoritarian and unquestionable obedience to law which are deprived of reasonable foundation. In this essay, the author criticizes cited interpretations and will try to investigate the authority of law from a virtue ethical perspective. In this recent view, citizens obey the law simply because it helps them to gain moral virtues. In those cases whereby citizens can’t construct a dialogue with law, they have civil disobedience option.
