نقش توسعۀ پایدار در ارتقای مشروعیت دموکراتیک در حقوق بین‌الملل

حقوق بین‌الملل موجود، از حیث مشروعیت با مشکلاتی روبه‌روست که این مسئله به‌دلیل عضویت دولت‌های غیردموکراتیک در جامعۀ جهانی نه‌تنها رفع نشده است، بلکه همواره تشدید می‌شود. توسعۀ پایدار از مفاهیم نسبتاً نوین حقوق بین‌الملل است که التزام به آن می‌تواند به طرق گوناگون از جمله به‌واسطه ارتقای وضعیت دموکراسی در نظام حقوق بین‌الملل، برای آن مشروعیت بیافریند. این مقاله بر مبنای روش توصیفی - تحلیلی، با واکاوی سه گزاره و شناسایی ارتباط میان آنها، چگونگی ارتقای سطح دموکراسی و در نتیجه مشروعیت را ذیل تعهد به توسعۀ پایدار روشن می‌کند: اول اینکه دموکراسی به معنی حکمرانی بر اساس آرای مردم است؛ دوم اینکه مشروعیت به معنی برخورداری از مقبولیت نزد مردمان است و سوم اینکه توسعۀ پایدار، دموکراسی را به‌عنوان مقدمه و نیز نتیجه خود معرفی می‌کند. نظام حقوق بین‌الملل برای وضع و اجرای قواعد و پایداری، نیازمند مشروعیت است و مفهوم توسعۀ پایدار با تاکید بر توانمندسازی افراد انسانی و لزوم مشارکت همگانی در درون کشورها و نیز در عرصۀ بین‌المللی، این مشروعیت را تامین خواهد کرد.

existing international law faces legitimacy issues, a problem that has not only persisted due to the membership of non-democratic states in the global community but has also been exacerbated. sustainable development is a relatively new concept in international law, and commitment to it can create legitimacy in various ways, including through the enhancement of democracy in the international legal system. this paper, based on a descriptive-analytical method, explores three propositions and identifies the relationship between them to clarify how the level of democracy and, consequently, legitimacy can be elevated under the commitment to sustainable development: first, democracy means governance based on the will of the people; second, legitimacy means having acceptance among the populace; and third, sustainable development introduces democracy as both a prerequisite and a result of its own. the international legal system requires legitimacy for the establishment and enforcement of rules and sustainability, and the concept of sustainable development, emphasizing the empowerment of individuals and the necessity of public participation both within countries and in the international arena, will provide this legitimacy.
