جایگاه قانون در تحدید حق آزادی اقتصادی شهروندان

فلسفه حاکمیت قانون تحدید و تعیین میزان صلاحیت دولت به‌منظور حفظ حقوق و آزادی‌های شهروندان است. این در حالی است که تجارب و اتفاقات تاریخی موجد نظریات موجه‌ساز مداخله دولت، به‌ویژه در اقتصاد شدند؛ تا جایی که عملاً در بسیاری از موارد حاکمیت قانون به حاکمیت به‌وسیله قانون مبدل شد. حال آنکه با توجه به پیچیدگی، تکثر روابط و پدیده‌ها و پویایی بازار، پیش‌بینی، هدف‌گذاری و برنامه‌ریزی برای آن میسر نیست. افزون بر این برنامه‌ریزی مستلزم جمع‌آوری اطلاعات شخصی و تعرض به حریم خصوصی افراد است. مهم‌تر آنکه اجرای آن نیازمند تحمیل از سوی دولت و در تعارض با حق آزادی اقتصادی شهروندان است. حق آزادی اقتصادی به‌عنوان زمینه‌ساز بهره‌مندی از سایر آزادی‌ها در نظم خودجوش و روابط برساخته بازار تامین می‌شود و قانون با ویژگی‌ها و خصیصه‌های مورد بحث از منظر فلسفه قانون و قانونگذاری در این زمینه کارا و موثر نیست. اساساً حاکمیت قانون به‌عنوان یکی از شاخص‌های مهم حق آزادی اقتصادی، تنها در مفهوم اصیل خود و در حمایت از حق مالکیت خصوصی، توافق اراده‌ها و ایجاد نهاد قضایی مستقل و بی‌طرف می‌تواند حافظ آزادی شهروندان باشد و قانونگذاری در سایر موضوعات و مصادیق اقتصادی به تضییع حق آزادی اقتصادی منجر می‌شود.
