واکاوی چالش‌های صیانت از حقوق شهروندی در ایران؛ مطالعه موردی نهاد قوه قضاییه

اهمیت صیانت از حقوق شهروندی در نظام سیاسی جمهوری اسلامی به‌حدی است که در تمامی اسناد بالادستی و همچنین پایین‌دستی این مقوله منعکس شده است. قوه قضاییه هم بر اساس اصول 156 و 169 قانون اساسی مسئولیت حمایت و اجرای عدالت و صیانت از حقوق شهروندی را بر عهده دارد، اما سخن آن است که این نهاد در ارتباط با اجرای وظایف اساسی خود مندرج در اصول قانون اساسی با چه چالش‌های مواجه شده است؟ این پژوهش با استفاده از روش توصیفی-تحلیلی نشان می‌دهد قوه قضاییه با چالش‌هایی نظیر وجود برخی مفاهیم و مصادیق جدید در خصوص کرامت انسانی، بی‌توجهی و عدم مشارکت سایر قوا در قبال مسئولیت خود، عدم استقلال مالی قوه قضاییه، حجم ورودی پرونده‌ها و اطاله دادرسی، تعارض در تصمیمات قضایی، عدم ارتباط مناسب بین قوای سه‌گانه، عدم ارتباط مناسب بین قوه قضاییه و قوه مجریه در قلمرو سیاست جنایی، جامع و شفاف نبودن قوانین در حوزه حقوق و آزادی‌های عمومی و ابهامات موجود در مفاهیم حق، تکلیف و مفهوم شهروندی مواجه است.

an analysis of the challenges in protecting citizens’ rights in iran: a ‎case study of the judiciary institution

the importance of protecting citizens’ rights within the political system of the islamic republic is such that it is reflected in all higher and lower-level documents. the judiciary is responsible for supporting and enforcing justice and safeguarding citizens’ rights based on articles 156 and 169 of the constitution. however, the question arises: what challenges does this institution face in fulfilling its fundamental duties as outlined in the constitution? this research, using a descriptive-analytical method, shows that the judiciary encounters challenges such as the existence of certain new concepts and instances regarding human dignity, negligence and lack of participation from other branches regarding their responsibilities, lack of financial independence of the judiciary, the volume of incoming cases and prolonged litigation, conflicts in judicial decisions, inadequate communication between the three branches of government, insufficient interaction between the judiciary and the executive in the realm of criminal policy, lack of comprehensiveness and clarity in laws concerning public rights and freedoms, and ambiguities in the concepts of rights, duties, and citizenship.
