   ارزیابی پایبندی دولت‏ ها به توصیه‏ های گروه ویژۀ اقدام مالی در مبارزه با تامین مالی تروریسم

چکیده    گروه ویژۀ اقدام مالی در حال حاضر فعال‏ ترین و پویاترین نهاد در جهت استانداردسازی و ایجاد روش ‏های جدید برای انسداد راه‏ های پول‏شویی و تامین مالی تروریسم است. از مهم‏ترین اقدامات این نهاد، آماده‏ سازی و ارائۀ توصیه‏ های چهل ‏گانه است که کشورها باید در نظام مالی خود آنها را رعایت کنند تا راه هرگونه سوءاستفاده از سیستم مالی و بانکی آن کشور مسدود شود. برخی از این توصیه ‏ها دارای سابقه در قطعنامه ‏های شورای امنیت یا کنوانسیون مبارزه با تامین مالی تروریسم بوده و برخی نیز جدید هستند. هرچند توصیه‏ های گروه ویژۀ اقدام مالی غیرالزام‏ آور و جزو حقوق نرم محسوب می‏ شوند، اما عدم رعایت آنها از سوی دولت‏ ها موجب بی‏ اعتمادی سرمایه‏ گذاران به سیستم مالی آن دولت خواهد شد. با وجود این بررسی‏ ها نشان می‏دهد آن دسته از توصیه‏ های گروه ویژۀ اقدام مالی که دربردارندۀ قواعدی مشترک با آنچه در کنوانسیون مبارزه با تامین مالی تروریسم یا قطعنامه‏ های فصل هفتمی شورای امنیت است، بیشتر مورد استقبال دولت‏ ها قرار گرفته و برعکس دولت ‏ها به توصیه ‏هایی که دربردارندۀ قواعدی جدید بوده و با سازوکارهای الزام‏ آور پشتیبانی نمی‏ شوند کمتر پایبند بوده ‏اند و این می‏تواند اماره ‏ای بر علت پایبندی دولت‏ ها به توصیه‏ های یک نهاد غیرالزام ‏آور باشد.

   assessment of states’ adherence to the recommendations ‎of the financial action task force (fatf) in combating ‎terrorism financing

Abstract    the financial action task force is currently the most active and dynamic entity in standardizing and creating new methods to block avenues for money laundering and terrorism financing. one of its most important actions is the preparation and presentation of forty recommendations that countries must adhere to within their financial systems to prevent any misuse of their financial and banking systems. some of these recommendations have a history in security council resolutions or the convention on combating the financing of terrorism, while others are new. although the recommendations of the financial action task force are non-binding and considered soft law, non-compliance by governments can lead to a lack of investor confidence in that government’s financial system. nevertheless, studies indicate that those recommendations from the financial action task force that contain common rules with what is outlined in the convention on combating the financing of terrorism or security council chapter vii resolutions are more welcomed by governments. in contrast, governments have shown less adherence to recommendations that contain new rules and lack backing from binding mechanisms, which may indicate the reasons for governments’ compliance with the recommendations of a non-binding entity.
