جنگ‌افزارهای خودفرمان از منظر حقوق بین‌الملل بشردوستانه

از آنجا که نه در حقوق بین‌الملل عرفی و نه در حقوق بین‌الملل معاهداتی به‌طور خاص به قانونی بودن جنگ‌افزارهای خودفرمان از منظر حقوق بین‌الملل بشردوستانه پرداخته نشده است، باید حقوق مربوط به جنگ‌افزارهای خودفرمان را بر اساس اصول بنیادین حقوق بین‌الملل بشردوستانه موجود بررسی کرد؛ مقصود این مقاله آن است که در ابتدا به توضیح جنگ‌افزارهای خودفرمان بپردازد و سپس قانونی بودن این‌گونه تسلیحات را از منظر حقوق بین‌الملل بشردوستانه تجزیه‌وتحلیل کند. هدف کلی‌ای که این مقاله به دنبال آن است، این موضوع است که آیا استقرار و به‌کارگیری جنگ‌افزارهای خودفرمان به‌دلیل محدودیت‌های تکنولوژیکی و حقوقی، قانونی است یا خیر. از سوی دیگر این مقاله همچنین در پی آن است که مسیر قانونی ساختن جنگ‌افزارهای خودفرمان را بررسی کند. در واقع در این مقاله نشان داده خواهد شد که اگرچه در حال حاضر جنگ‌افزارهای خودفرمان از حقوق بین‌الملل بشردوستانه تخطی می‌کنند، اما توان بالقوه آن را دارند که با اصول حقوق بین‌الملل بشردوستانه، در آینده تطابق بیشتری داشته باشند.

autonomous weapons from the perspective of international humanitarian law

considering that neither customary international law nor international treaties have specifically addressed the legality of autonomous weapons from the point of view of international humanitarian law, the law on autonomous weapons should be analyzed under the fundamental principles of international humanitarian law. the first purpose of this study is to explain the autonomous weapons and then to analyze the legality of such weapons through the lens of international humanitarian law. the basic question of the paper is whether the deployment of autonomous weapons is legal in light of technological and legal limitations? on the other hand, the paper also seeks to examine the legalization of autonomous weapons. in fact, the findings of our study will show that although autonomous weapons currently violate international humanitarian law, they have the potential to be more consistent with the principles of international humanitarian law in the future.
