ابعاد حقوقی استفادۀ گروه‌های غیردولتی از سلاح زیستی

در عصر کنونی یکی از چالش‌های مهم جامعۀ جهانی، پدیدۀ بیوتروریسم است که علاوه بر دولت‌ها از سوی برخی از گروه‌های غیردولتی نیز به‌کار گرفته شده است. با توجه به آثار و صدماتی که اقدامات بیوتروریستی گروه‌های غیردولتی بر حیات بشری دارد، تحقیق حاضر به بررسی ابعاد حقوقی این موضوع پرداخته است. در این زمینه در بخش نخست، مفهوم گروه‌های غیردولتی و رویکرد آنها نسبت به استفاده از سلاح‌های بیولوژیکی، توضیح داده شده است. در بخش دوم، رویکرد نظام حقوق بین‌الملل به استفاده گروه‌های غیردولتی از سلاح‌های بیولوژیک، بررسی و در نهایت در بخش سوم، رویکرد دولت‌ها در خصوص اقدامات بیوتروریستی گروه‌های غیردولتی و مسئولیت آنها در این زمینه تبیین شده است. یافته‌های این پژوهش دلالت بر آن دارد که برخی گروه‌های غیردولتی برای ارتکاب اعمال تروریستی، به دلایل متعدد، تمایل به استفاده از سلاح‌های بیولوژیک دارند. با آنکه تاکنون چند سند بین‌المللی در زمینۀ تروریسم و بیوتروریسم به تصویب رسیده، اما این اسناد نتوانسته‌اند مانع از اقدامات بیوتروریستی این گروه‌ها شوند. همچنین بسیاری از دولت‌ها در نظام‌های حقوقی داخلی خود، سازوکارهای قانونی مناسبی برای مقابله با اقدامات بیوتروریستی گروه‌های غیردولتی نداشته یا آنکه به دلایل اقتصادی و سیاسی تمایل چندانی به مقابله با اقدامات بیوتروریستی این گروه‌ها ندارند.

legal implications of non-state actors’ use of biological weapons

in the current age, one of the most important challenges of the international community is the phenomenon of bioterrorism, which has been used by some non-state actors in addition to states. given the destructive effects and irreparable damage that the bioterrorist actions of non-state actors have on human life, the present article examines the legal aspects of this issue. in this regard, in the first part of the article, the concept of non-states actors and their approach to the use of biological weapons were explained. in the second part, the approach of the international law system to the use of biological weapons by non-state actors is examined, and finally in the third part, the approach of governments regarding the bioterrorist actions of non-state actors and their responsibilities in this field are explained. the findings of this article indicate that some non-state actors tend to use biological weapons to commit terrorist acts for a variety of reasons. although several international instruments on terrorism and bioterrorism have been adopted so far, these instruments have not been able to prevent the bioterrorist activities of these groups. in addition, many governments in their domestic legal systems do not have adequate legal mechanisms to counter the bioterrorist activities of non-state actors, or for economic and political reasons are reluctant to counter the bioterrorist activities of these groups.
