چالش ‌های محرمانگی مقررات در نظام حقوقی ایران

انتشار قوانین و مقررات همواره به عنوان یکی از مراحل اساسی فرایند تقنین و مقرره‌گذاری مورد پذیرش حقوقدانان بوده است. در نظام حقوقی جمهوری اسلامی ایران نیز «قانون انتشار و دسترسی آزاد به اطلاعات»، مصوب 1387، بر لزوم انتشار و ممنوعیت طبقه‌بندی و محرمانگی اسناد موجد حق و تکلیف، از جمله مقررات اعم از آیین‌نامه‌ها، بخش‌نامه‌ها و شیوه‌نامه‌ها تصریح کرده است؛ با این حال همچنان در نظام حقوقی ایران مواردی از مقررات محرمانه و طبقه‌بندی‌شده وجود دارد. موضوعی که به عنوان یک ناهنجاری در عرصۀ حقوق عمومی، می‌تواند هر نظام حقوقی‌ای را با چالش‌هایی جدی مواجه کند و منجر به تضییع حقوق شهروندان شود. پژوهش حاضر با روش توصیفی-تحلیلی ضمن بررسی وضعیت موجود، سازکار «طبقه‌بندی و محرمانگی اسناد» و ضوابط «لزوم انتشار مقررات» و علل وجود مقررات محرمانه در نظام حقوقی جمهوری اسلامی ایران، در پی پاسخ به این پرسش است که مقررات محرمانه، نظام حقوقی ایران را با چه چالش‌هایی مواجه کرده است، و در نهایت تلاش می‌کند برای رفع این چالش‌ها، راهکارهایی با استفاده از ابزارهای حقوقی پیشنهاد کند.

challenges posed by the confidentiality of regulations in the iranian legal system ‎

the publication of laws and regulations has always been accepted by legal scholars as an essential  stage in the the legislative process. in the legal system of the islamic republic of iran, the law on the publication and free access to information, passed in 2008, emphasizes the necessity of publication and prohibits the classification of documents that create rights and obligations, including regulations such as bylaws, circulars, and guidelines. however, there are still instances of classified and confidential regulations within the iranian legal system. this issue, regarded as a deviation in terms of public law norms, can pose serious challenges to any legal system and lead to the infringement of citizens' rights. the present research, using a descriptive-analytical method, examines the mechanism for the classification and confidentiality of documents, the criteria for the necessity of publishing regulations, and the reasons for the existence of confidential regulations in the legal system of the islamic republic of iran. it seeks to answer the question, what challenges confidential regulations pose to the iranian legal system? the paper ultimately aims to propose solutions using legal tools to address these challenges.
