نقض قواعد بین‌المللی دولت عراق در به شهادت رساندن سپهبد قاسم سلیمانی

در ساعت 1:07 بامداد در 13 دی 1398، ارتش ایالات متحدۀ آمریکا به دستور دونالد ترامپ، سپهبد قاسم سلیمانی و ابومهدی المهندس و دیگر همراهان را در عملیاتی به نام آذرخش کبود به شهادت رساند. در این مقاله سعی می‌شود تا ابهامات مربوط به توجیهات ایالات متحده در ترور سپهبد قاسم سلیمانی، شهید ابومهدی المهندس و دیگر همراهان از دیدگاه حقوق بین‌الملل تجزیه‌وتحلیل و با بهره‌گیری از اصول و اسناد بین‌المللی در موضوعات مختلف اقدام تروریستی و توجیهات دولت آمریکا در ترور سپهبد سلیمانی بررسی شود و به سوالات مربوط به آیا عمل آمریکا در اصول دفاع مشروع، توجیه‌پذیر است، آیا منطبق با معاهدات بین‌المللی بوده؟ پاسخ داده شود. با استفاده از روش توصیفی –تحلیلی مبتنی بر جمع‌آوری اطلاعات کتابخانه‌ای، به بررسی نقض قواعد بین‌المللی و حاکمیت دولت عراق در شهادت رساندن سپهبد قاسم سلیمانی پرداخته شده است. در نتیجه اقدام آمریکا در ترور سپهبد حاج قاسم سلیمانی با استناد به اصول و اسناد بین‌المللی ضمن نقض حاکمیت دولت عراق، موجه و مشروع نیست.

at 1:07 a.m. on january 13, 2018, the united states army assassinated lieutenant general qassem soleimani, abu mehdi al-muhandis and other companions in an operation called azarakhsh kobood on the orders of donald trump. this paper tries to analyze the uncertainties related to the justifications of the united states in the assassination of lieutenant general qassem soleimani, martyr abu mahdi al-muhandis and other companions from the perspective of international law, using international principles and instruments on various issues of terrorist acts and the justifications of the american government in the assassination of lieutenant general soleimani, and to the questions related to whether the action of the united states is justified in the principles of legitimate defense, was it in accordance with international treaties? using a descriptive-analytical method, based on library resources, the violation of international rules and the sovereignty of the iraqi government in the martyrdom of lieutenant general qassem soleimani has been investigated. as a result, the action of america in the assassination of lieutenant general hajj qassem soleimani, citing international principles and documents, while violating the sovereignty of the iraqi government, is not justified and legitimate.
