خوانش «سیاستگذاری عمومی» از دیدگاه حقوق عمومی

مطالعات میان‌رشته‌ای از حوزه‌های جدید در معرفت‌شناسی است که از قلمرو مطالعات کلاسیک و محض یک دانش فرا می‌رود و روش تازه‌ای را پیش‌روی ما می‌گذارد. سیاستگذاری عمومی از مفاهیم میان‌رشته‌ای در علوم انسانی است که به فراخور کاربرد زمینه‌ای‌اش، از یک «مفهوم تخصصی» تا یک «رشتۀ دانشگاهی» شناخته می‌شود. این وضعیت گویای اهمیت و ظرفیت بالایِ آن در میانۀ مفاهیم علوم انسانی است. نوشتار حاضر با درک چنین اهمیتی، درصدد واکاوی این مفهوم در دانش حقوق عمومی برآمده است و به این سوال پرداخته است: خوانش «سیاستگذاری عمومی» در حقوق عمومی چیست؟ در این زمینه مقاله پیشِ‌رو به لحاظ هدف بنیادی بوده و با استفاده از روش توصیفی-تحلیلی به این نتایج دست یافته است که اولاً ماهیت بین‌رشته‌ای سیاستگذاری عمومی، فضا را برای فهم شایسته و دقیق این مفهوم در حقوق عمومی سخت می‌سازد؛ ثانیاً از آنجایی که جایگاه نخستین این مفهوم در دانش‌های دیگر قرار دارد، ازاین‌رو حقوق عمومی فقط به‌عنوان دانش متاخر، می‌تواند از ظرفیت‌های آن بهره‌برداری کند؛ ثالثاً خوانش مفهوم مذکور در حقوق عمومی، اساساً به اتکای زمینۀ کاربردی‌اش در حقوق، مانند سیاست‌های قضایی، قابل ارزیابی حقوقی است. بنابراین، این مفهوم در حقوق عمومی به‌تنهایی نمی‌تواند به‌عنوان تاسیس تخصصی به‌شمار آید؛ رابعاً به‌نظر می‌رسد مفاهیم سیاست و سیاستگذاری در لحظه‌ای که به‌عنوان مفهومِ میان‌رشته‌ای در میانۀ دانش‌های خاص قرار می‌گیرند، رنگ و بوی مفهوم‌شناسانه پیدا کرده و به فراخور زمینه دانشیِ خاص، قابل بحث هستند.

reading public policy from the perspective of public law

interdisciplinary studies are one of the new fields in epistemology, which have gone beyond the realm of classical studies and offer us a new methodology. public policy is an interdisciplinary concept in human sciences that is known for its contextual application, as a specialized concept to an academic discipline. this situation shows its importance and high capacity among the concepts of human sciences. understanding such importance, the present paper seeks to explore this concept in the knowledge of public law. in this regard, this paper achieved these results using a descriptive-analytical method. first; the interdisciplinary nature of public policy makes it difficult to properly and accurately understand this concept in public law. secondly; since the first place of this concept is in other sciences, so public law can use its capacity only as a succedent knowledge. thirdly; the reading of the mentioned concept in public law can be evaluated as legal based on its practical context in law, such as judicial policies. therefore, the concept in public law alone cannot be considered as a specialized establishment. fourth; it seems that the concepts of politics and policy-making at the moment when they are placed as an interdisciplinary concept among specific sciences have a conceptual color and smell and can be discussed according to the context of a specific knowledge.
