آزادی پوشش مذهبی بانوان مسلمان از منظر حقوق بین‌الملل با تاکید بر آرای دیوان اروپایی حقوق بشر

از آنجا که در دهه‌های اخیر برخی کشورهای اروپایی محدودیت‌هایی را برای پوشش بانوان مسلمان وضع کرده‌اند، ازاین‌رو تبیین وضعیت آزادی پوشش بانوان از منظر حقوق بین‌الملل ضروری است. این پژوهش سعی دارد با استفاده از آرای دیوان اروپایی حقوق بشر و اسناد و تعهدات بین‌المللی موجود در این زمینه، واژه محدودیت‌های ایجادشده علیه پوشش مذهبی بانوان مسلمان را به چالش بکشد و لزوم تامین حق آزادی پوشش مذهبی را تبیین سازد. پرسش اساسی مقاله حاضر آن است که آیا مخالفت با پوشش مذهبی و حجاب بانوان در کشورهای اروپایی مغایر با حقوق بین‌الملل و حقوق بشر است یا خیر؟ مقاله پیش‌رو با روش توصیفی – تحلیلی و ابزار کتابخانه‌ای شامل بررسی اسناد موجود، به این نتیجه نائل می‌آید که ممنوع دانستن پوشش مذهبی نقض حقوق بشر افراد و آزادی دینی آنان است و این ممنوعیت بیش از آنکه بر مبانی حقوقی محکمی استوار باشد، ریشه در فشارهای سیاسی و اجتماعی دارد.

freedom of muslim women’s religious clothing from the perspective of international law with emphasis on echr jurisprudence

since in recent decades, some european countries have placed restrictions on muslim women’s clothing, it is necessary to explain the status of women’s freedom of clothing in the context of international law. this study using the judgments of the european court of human rights and international instruments and obligations in this field, tries to challenge the inconsistency of restrictions on the religious clothing of muslim women and explain the need to ensure the right to freedom of religious clothing. the main question of the present paper is that the opposition to religious clothing and hijab of women in european countries is contrary to international law and human rights or not? this paper concludes with a descriptive-analytical method and library resources including the examination of existing instruments that the prohibition of religious clothing is a violation of human rights and their religious freedom, and such a prohibition is based more on political and social pressures than on solid legal principles.
