ساز و کارها و چالش‌ های انتقال بین ‌المللی سوابق بیمۀ تامین اجتماعی

حمایت از حقوق تامین اجتماعی کارگران مهاجر و اعضای خانوادۀ آنان به‌عنوان یک مسئلۀ حقوق بشری، در یک قرن اخیر مورد توجه بسیاری از نهادها بین‌المللی قرار گرفته است. یکی از جلوه‌های این توجه، مسئلۀ شناسایی و پذیرش حقوق مکتسبۀ تامین اجتماعی آنان است؛ از جمله مصادیق حقوق مکتسبۀ تامین اجتماعی کارگران مهاجر را باید سوابق بیمه‌ای کسب‌شده توسط آنان در کشور یا کشورهای محل اشتغال پیشین دانست. با توجه به اهمیتی که این موضوع برای کارگران مهاجر دارد در این مقاله به بررسی ابعاد حقوقی انتقال بین‌المللی سوابق بیمۀ تامین اجتماعی پرداخته شده است. یافته‌های این پژوهش، دلالت بر آن دارد انتقال بین‌المللی سوابق بیمه‌ای دارای شرایط متعدد، شامل عضویت در نظام بیمه‌ای، اقامت در کشور میزبان و وجود موافقت‌نامه بین‌المللی تامین اجتماعی میان کشور مبدا و مقصد کارگر مهاجر است. در حال حاضر، بیشتر کشورهای در حال توسعه در زمینۀ انتقال بین‌المللی سوابق بیمه‌ای با چالش‌های مختلفی مواجه‌اند که برجسته‌ترین آنها عبارت‌اند از: محدودیت‌های انتقال داخلی سوابق بیمه‌ای، تفاوت در نظام تامین اجتماعی کشورها و رویکرد سلبی کشورها نسبت به انعقاد موافقت‌نامه‌های بین‌المللی تامین اجتماعی یا الحاق به اسناد مصوب سازمان ملل متحد و سازمان بین‌المللی کار.

the mechanisms for and challenges of the international transfer of social security contributions

supporting the social security rights of migrant workers and their family members as a human rights issue has been the focus of many international institutions in the last century. one of the manifestations of this attention is the issue of recognizing and accepting their acquired social security rights; among the examples of acquired social security rights of migrant workers, the contribution periods acquired by them in the country or countries of their previous employment should be considered. considering the importance of this issue for migrant workers, this paper examines the legal aspects of the international transfer of social security contribution periods. the findings of this research indicate that the international transfer of contribution periods has several conditions, including: membership in the insurance system, residence in the host country, and the existence of an international social security agreement between the migrant worker's origin and destination country. currently, most of the developing countries are facing various challenges in the field of international transfer of contribution periods, the most prominent of which are: limitations of the internal transfer of contribution periods, differences in the social security system of countries and the negative approach of countries towards concluding agreements between international social security or accession to the documents approved by the united nations and the international labor organization.
