تاملی بر «برنامه جامع همکارهای فی ‏مابین ایران و چین» از منظر حقوق بین ‏الملل

در 7 فروردین ‏ماه 1400 وزیر خارجه دولت چین طی سفری رسمی وارد تهران شد و در بحبوحه مباحث بازگشت ایالات متحده به برجام و خرابکاری‏ هایی که در سایت هسته‏ ای نطنز اتفاق می‏افتاد، موافقت‏ نامه ‏ای با عنوان «برنامه جامع همکاری های فی ما بین ایران و چین» منعقد شد. ابعاد بسیار وسیع این تفاهم نامه در حوزه ‏های متنوع اقتصادی، امنیتی، نظامی، گردشگری ، فرهنگی، دانشگاهی و با تمرکز ویژه روی مسئله انرژی به‏ خصوص خرید نفت و محصولات پتروشیمی توسط دولت چین از ایران در بازه زمانی 25 ساله، ابهامات فراوانی را به‏ وجود آورد و حتی برای افرادی که در این حوزه به صورت حرفه ‏ای فعالیت داشتند، پرسش ‏هایی مطرح شد؛ از جمله اینکه چرا در این زمان این تفاهم ‏نامه منعقد شد و چرا مدت زمان آن 25 سال است. در این نوشتار با هدف رفع ابهامات موجود، این تفاهم ‏نامه از منظر موازین حقوق بین ‏المللی تجزیه ‏و تحلیل می‏شود.

a reflection on the comprehensive program of cooperation between iran and china from the perspective of international law

on 27 march 2021, the chinese foreign minister arrived in tehran as an official visit, and in the midst of discussions about the us return to the joint comprehensive plan of action and the sabotage at the natanz nuclear site, an agreement was reached entitled comprehensive program of cooperation between iran and china. the very broad dimensions of this agreement in various economic, security, military, tourism, cultural, academic fields and with a special focus on the issue of energy, especially the purchase of oil and petrochemical products by china from iran over a 25-year period, leave many ambiguities. it even raised questions for experts in the field, including why it was signed at this time and why for 25 years. in this paper, with the aim of resolving the existing ambiguities, we analyze this agreement from the perspective of international law.
