الزامات حقوقی ضمانت اجرای سیاست‌های کلی نظام

یکی از مشکلات عدیدۀ کشور، بی‌توجهی دستگاه‌ها و قوای حکومتی- به‌خصوص قوۀ مجریه و مقننه- نسبت به «حسن اجرای سیاست‌های کلی نظام» است که در بلندمدت، ضمن بر هم زدن ثبات رویه‌های کلان نظام، موجب کاهش تاثیرگذاری و اقتدار «ولایت امر» در هدایت جامعه و ادارۀ حکومت؛ و ناتوانی ایشان در «تضمین عدم انحراف سازمان‌ها از وظایف اصیل اسلامی‌شان» خواهد شد. پژوهش حاضر براساس روش توصیفی - تحلیلی تلاش دارد از زاویه و جهتی نو و با رویکرد حقوقی دریابد چگونه می‌توان با بهره‌گیری از ظرفیت‌های حقوق اساسی کشور، مصادیق ضمانت اجرای تحقق سیاست‌های کلی نظام را تقویت کرد؟ از آنجا که حسن اجرای سیاست‌های کلی نظام توسط قوای سه‌گانه و نهادهای عمومی، الزامی است، مهم‌ترین عامل تحقق آنها، بهره‌گیری از انواع ضمانت‌های اجرایی کارامد و موثر است. در همین زمینه، برخی از ضمانت‌های اجرایی حقوقی و سیاسی قابل طرح در مواجهه با بی‌توجهی قوا به حسن اجرای سیاست‌ها بیان خواهد شد.

legal requirements to guarantee the implementation of the general policies of the system

one of the country’s most pressing problems is the inattention of state institutions - especially the executive and legislative branches – to the “sound implementation of the general policies of the system as promulgated by the grand leader. this issue can, in the long run, disrupt the stability of the system and the ability of the leader to discharge his functions and to ‘ensure that institutions do not deviate from their original islamic duties’. the present research, based on a descriptive-analytical approach, seeks to find out how the legal sanctions of the “general policies of the system” can be strengthened through constitutional-law capacities. since it is imperative for the general policies of the system to be implemented by the three branches and the public institutions, the most important factor for their realization is to use a variety of efficient and effective sanctions. in this context, some legal and political sanctions that can be proposed in the face of the neglect of the ability to properly implement policies will be stated.
