آزادی بیان در رویۀ کمیتۀ حقوق بشر و دیوان اروپایی حقوق بشر

آزادی بیان عبارت از آن است که انسان به‌سبب برخورداری از کرامت ذاتی، حق ارائۀ یافته‌های خردورزانه و برخاسته از این کرامت را در قالب گفتار، نوشتار، اثر هنری، تبلیغات تجاری و... دارد. بی‌توجهی بسیاری از دولت‌ها به آزادی بیان، موجب شده است که افراد بعد از ناامید شدن از نهادهای قضایی داخلی به‌منظور تضمین این حق، به نهادهای بین‌المللی جهت احقاق حق خود روی آورند. در میان دادگاه‌های بین‌المللی، دادگاه اروپایی حقوق بشر و کمیتۀ حقوق بشر سازمان ملل متحد با برخورداری از صلاحیت رسیدگی به شکایات افراد، آنها را در برابر دولت‌ها زیر چتر حمایتی خود قرار می‌دهند. پرسش اساسی مقاله حاضر آن است که آزادی بیان در رویۀ کمیتۀ حقوق بشر ملل متحد و رویۀ قضایی دادگاه اروپایی حقوق بشر چه بازتابی داشته است؟ مقاله پیش‌رو با روش توصیفی – تحلیلی و ابزار کتابخانه‌ای شامل بررسی اسناد موجود، به این نتیجه نائل می‌آید که در رویۀ دادگاه اروپایی حقوق بشر، گاه از آزادی بیان بسیار محدود و گاه بسیار مطلق (بی‌حدوحصر) حمایت به‌عمل آمده و در کمیتۀ حقوق بشر نیز بعضاً به بهانه کافی نبودن شواهد و مدارک، تصمیماتی ناعادلانه اتخاذ شده است که تضمین‌کننده آزادی بیان به‌نحو مطلوب نیست.

freedom of expression in the practice of the human rights committee and the jurisprudence of the european court of human rights

freedom of expression means that human beings, due to their inherent dignity, have the right to present rational findings arising from this dignity in the form of speech, writing, artwork, commercial advertising, and so on. freedom of expression violations by states have led individuals to turn to international institutions to enforce their rights after being failed by domestic judicial institutions. among international bodies, the european court of human rights and the human rights committee, which have jurisdiction over individual complaints, are able to protect individuals against states. the main question of the present paper is how has freedom of expression been reflected in the jurisprudence of the european court of human rights and the human rights committee? this paper using a descriptive-analytical method and library findings including a review of existing instruments concludes that the jurisprudence of the european court of human rights includes  both limited and expansive protection of freedom of expression. also in the practice of the human rights committee, sometimes due to insufficient evidence, unfair decisions have been made which do not guarantee freedom of expression in a desirable way.
