حق عبور بی‌ضرر کشتی‌های هسته‌ای و حامل مواد هسته‌ای در حقوق بین‌الملل و نظام حقوقی ایران

عبور بی‌ضرر حقی است که حقوق بین‌الملل به کشتی‌های تمام کشورها به‌منظور عبور از برخی مناطق دریایی تحت حاکمیت دولت‌ها اعطا کرده است. کنوانسیون 1982 ملل متحد در خصوص حقوق دریاها، با رعایت شرایطی، این حق را در مورد کشتی‌های هسته‌ای و حامل مواد هسته‌ای نیز به رسمیت شناخته است. این در حالی است که در قوانین ملی و رویه بین‌المللی برخی دولت‌ها، از جمله ایران، این کشتی‌ها یا مشمول چنین حقی نشده یا عبور آنها به رعایت شرایطی مازاد بر شرایط کنوانسیون منوط شده است. با وجود چنین قوانین و رویۀ متفاوتی، تبدیل مقررات کنوانسیون مذکور در خصوص عبور بی‌ضرر کشتی‌های هسته‌ای و حامل مواد هسته‌ای به قواعد عام حقوق بین‌الملل به‌سختی ممکن شده و اعمال آنها صرفاً به طرف‌های کنوانسیون محدود می‌شود.

the right of innocent passage of nuclear-powered ships and ships carrying nuclear substances in international law and the iranian legal system

the right to innocent passage is a right conferred by international law on ships of all states to pass through the territorial waters of costal states. the 1982 un convention on the law of the sea (the los convention), subject to certain conditions, has recognized this right for both nuclear powered ships and ships carrying nuclear substances. however, in the national law and practice of some states, including iran, these ships are either deprived from the right of innocent passage or their passage is subject to conditions and/or restrictions in excess of the terms of the los convention. in view of such laws and practices, it would seem that the los convention’s provisions on innocent passage of nuclear powered ships and ships carrying nuclear substances  cannot be considered as general international law and their applicability is limited to the states parties to the los convention.
