دوگانگی شخصیت حقوقی شورای شهر و شهرداری؛ آسیبشناسی ساختاری نهاد محلی در ایران

چکیده
|
طبق ماده 3 قانون شهرداری مصوب 1334، شهرداری دارای شخصیت حقوقی است. در تمامی قوانین مربوط به شهرداری از ابتدای قانونگذاری در ایران، رکن انتخابی شهرداری با عناوین مختلفی مانند انجمن بلدیه یا انجمن شهر وجود داشته و بهعنوان یکی از ارکان داخلی شهرداری بدون شخصیت حقوقی مستقل عمل میکرده است. این مقاله با روشی تحلیلی-تاریخی به این پرسش میپردازد که منشا اصلی تنش ساختاری بین شورای اسلامی شهر و شهرداری در حال حاضر ناشی از چه عواملی است. در قوانین مربوط به شوراها پس از انقلاب، شوراها خود بهطور مستقل واجد شخصیت حقوقی شدند و از نظر حقوقی، شکافی ساختاری میان رکن اجرایی (شهرداری و دهیاری) با رکن نظارتی (شورای اسلامی شهر و روستا) ایجاد شده که افزونبر ناهماهنگی و فقدان انسجام ساختاری، آثار و پیامدهای تنشآفرینی از جمله ایجاد سازمان اداری زائد، تنشهای قضایی، اختلافهای مالی و بودجهای و ایجاد مسئولیت قانونی مضاعف را نیز بهوجود آورده است. بهنظر میرسد راهکار مناسب، بازگشت به الگوی تاریخی شهرداری و حذف شخصیت حقوقی شورای اسلامی شهر و ادغام آن در شخصیت واحد شهرداری باشد.

the dichotomy between municipality and city council’s legal personality: the structural pathology of local government in iran

Abstract
|
under article 3 of the [iranian] municipal act of 1955, municipalities have independent legal personality. meanwhile, the elective section of the municipality – then called “city association”- existed as an internal section of the municipality and not as a separate legal entity. after the islamic revolution, the new “city and rural islamic councils” gained a separate legal personality. thus, the structural gap between the executive section (municipality) and supervisory section (city and rural council) of local governments emerged. this led to structural incoherence and caused damaging consequences such as unnecessary administrative organs, judicial tensions, financial and budget disputes, and multiple legal responsibilities. using a historical analysis method, this paper will answer the question: what is the origin of the structural tension between the municipalities and city councils in iran? it seems the proper solution is returning to the original and historical model of the municipality in iran and the elimination of the city council’s legal entity and integrating it into the municipality.
