تاملی بر رویکرد نظام حقوقی جمهوری اسلامی ایران به حقوق رقابت در پرتو نظریه‌های عدالت

دولت‌ها محور اصلی اهداف خود در زمینه نظام‌های اقتصادی را، تشویق مردم به فعالیت و بهره‌گیری عادلانه از منابع قرار می‌دهند، اما تحقق اهداف مذکور با کاستی‌های شکلی و ماهوی مقررات حقوق خصوصی در حوزه قراردادها، با مشکلاتی مواجه شده است. ازاین‌رو نظام‌های حقوقی از حقوق رقابت به‌عنوان ابزار عمومی و نظارتی بهره می‌گیرند تا ضمن پاسخ به کاستی‌های مذکور، با تکیه بر نظریه‌های عدالت در سطوح مختلف از قانون اساسی تا قوانین عادی، رویکردهای حقوق رقابت را تبیین کنند، به‌نحوی که مداخله‌های حداقلی دولت، به دستیابی به کارایی و تخصیص بهینه منابع منجر شود. این مقاله با روش‌شناسی توصیفی تحلیلی به تبیین پرسش‌های موجود در خصوص رویکرد نظام حقوقی حاکم بر حقوق رقابت مبتنی بر تئوری‌های عدالت می‌پردازد و تغییر رویکردها را مبتنی بر نظریه‌های عدالت در نظام حقوقی ایران بررسی می‌کند.

a reflection on the approach of the legal system of the islamic republic of iran to competition law in light of theories of justice

governments set the main goals of their economic system on encouraging people to engage in economic activity and use resources fairly, but the achievement of these goals has been hampered by the formal and substantive shortcomings of private law in the field of contracts. legal systems use competition law as a public and regulatory tool to respond to these shortcomings, relying on theories of justice at various levels from the constitution to statutory law, so that minimal government intervention leads to efficiency and optimal resource allocation. this article uses descriptiveanalytical methodology to answer existing questions about the approach of the legal system governing competition law based on theories of justice and examines the change of approaches based on theories of justice in the iranian legal system.
