نقش دیوان دعاوی ایران – ایالات متحده در توسعه حقوق معاهدات

دیوان دعاوی ایران – ایالات متحده، به‌عنوان یک نهاد داوری موردی بین‌المللی، در راستای صلاحیت موضوعی اعطایی، رکن شایستۀ رسیدگی به اختلاف‌های فی‌مابین ایران و ایالات متحده در خصوص تفسیر یا چگونگی اجرای هریک از مقررات بیانیه‌های الجزایر است. از آنجا که «تفسیر»، واسط قاعده و واقعه است، ازاین‌رو دیوان برای تفسیر، مجاز است تا برای اتصال صحیح قاعده به واقعه، به اصول کلی حقوقی، عرف و تعهدات ضمنی نیز متوسل شود. در این زمینه دیوان تلاش کرد تا در چارچوب قواعد و مقررات حقوق بین‌الملل معاهدات، با ایجاد رویۀ قضایی منسجم حکم صادر کند؛ احکامی که سبب افزایش انگیزۀ دولت‌های ایران و ایالات متحده، برای تبعیت از اصول و قواعد حقوق بین‌الملل معاهدات شود. این مقاله بر آن است تا با تجزیه‌وتحلیل آرای صادره از سوی دیوان، توسعه و تعمیم رویه و عملکرد دیوان در اعمال این اقدام‌ها را مورد بررسی و مداقه قرار دهد.

the role of the iran - united states claims tribunal (iusct) in the development of law of treaties

settling the disputes between iran and the united states regarding the interpretation and enforcement, the algiers declarations is within the competence of the iranunited states claims tribunal (the tribunal) as an international ad hoc arbitration institution. interpretation is the intermediary between a legal rule and the event to which it is applied. as such, in order to correctly connect the rule to the event, the tribunal is allowed to resort to general principles of law, custom and implied obligations. in this regard, the tribunal has attempted to issue awards that establish a coherent case law within the framework of the international law of treaties. such decisions motivate the governments of iran and the united states to adhere to the principles and rules of the international law of treaties. this paper intends to study how the law of treaties has been develped by the awards of the tribunal.
