تحلیل خوانش‌های معاصر از نسبت قانون و شریعت در رساله «یک کلمه» میرزا یوسف‌خان مستشارالدوله

مفهوم قانون در معنای جدید کمی بیش از دو سده است که وارد منظومه فکری ایرانیان شده است و از همان ابتدای ورود در برخورد با فقه تعارضاتی میان آن دو آشکار شد. یکی از تلاش‌هایی که در پی رفع و توجیه این تعارضات شکل گرفت، رساله یک کلمه از مستشارالدوله است. متن این رساله سهل و ممتنع است، به‌گونه‌ای که تفاسیر مختلفی از مراد نویسنده در طول تاریخ ارائه شده است. این پژوهش نیز درصدد تحلیل و نقد سه خوانش اصلی از یک کلمه برآمد و سرانجام با روش تحلیل نظری و پردازش منطقی نشان داد که می‌توان نظریه مستشارالدوله را نوعی توجیه قانون از دریچه شریعت دانست که مستلزم برداشت قشری از مفهوم قانون و نگاهی غیراصیل به شریعت است و در نهایت نیز در حل تعارضات شریعت و قانون ناکام است.

Analysis of Contemporary Readings of the Relationship Between Law and Sharia in “Risalah YekKalameh”

The concept of law, in its modern sense, entered the Iranian intellectual discourse more than two centuries ago, and from the very beginning became a rival to sharia which was the ultimate legal order of Iranian society since the dawn of Islam. Many Iranian scholars tried to resolve the conflicts between the two. One of the most prominent works on this topic is Mirza Yousef MostasharAlDawlah’s “Risalah YekKalameh”. Reading this book is at once easy and difficult, so much so that there have been many interpretations of the author’s intentions. This study will attempt to critically analyze the three major interpretations of “Risalah YekKalameh”. The results of the study indicate that Mirza Yousef Khan failed to solve the conflict between sharia and law, because he did not understand the exact meaning of those concepts and their limits.
