تقابل حاکمیت و بشر در سازوکار قضایی حقوق بشر در آفریقا

حقوق بشر، در عصر حاضر، از مفاهیم نوظهور است که با حاکمیت، در مفهوم سنتی، در تعارض است. قارۀ آفریقا که نماد استعمار و دیکتاتوری و جغرافیایی مشهور به نقض حقوق بنیادین بشر در اعصار گذشته بوده است، پس از به‌دست آوردن حاکمیت مستقل و چشیدن طعم آن، اکنون با ایجاد ساختارهای قضایی حقوق بشری، سعی در تغییر شرایط به نفع انسان‌ها دارد. اما در این میان حاکمیت‌های سنتی آفریقایی که خود را مالک هر آنچه داخل مرزهای خود وجود دارد می‌دانستند، در مقابل این موج مقاومت می‌کنند. دیوان آفریقایی حقوق بشر که به‌منظور مقابله با نقض‌های حقوق بشری تاسیس شده است، در تقابلی آشکار با این تفکر سنتی حاکمان آفریقاست. در این رهگذر ساختار قضایی رسیدگی به تخلفات حقوق بشری در آفریقا با رویۀ خود و به‌روزآوری سند اصلی، در تلاش برای ارتقای وضعیت حقوق بشر در آفریقاست. استفادۀ گسترده از ادبیات حقوق بشری در سطح بین‌المللی و توجه بیش از حد به ساختار قضایی حقوق بشری اروپا، به‌ترتیب نقاط قوت و ضعف این نهاد است. حقوق بشر در قارۀ آفریقا در حال گذر از حاکمیت در مفهوم سنتی است، ولی برای عبور کامل از آن راه درازی در پیش دارد. عدم بهره‌مندی از حاکمیت واقعی در گذشته و تعاریف قبیله‌گرایانه از حاکمیت و انسان، مانع جدی کارامد شدن نظام قضایی این قاره است.

The Encounter of Sovereignty and Man in Africa’s Human Rights Judicial Mechanism

Human rights, is one of the emerging concepts that is in conflict with sovereignty, in its traditional sense. The African continent, which symbolized colonialism, dictatorship, and human right abuses in the past centuries, is now trying to change the situation in favor of human beings by creating judicial structures for the protection of human rights. Africa’s judicial system of human rights protection, with its practice and the endeavor to update its main instrument, is trying to improve the human rights situation in Africa. The extensive referral to international human rights literature and the excessive attention to the European human rights judicial system are respectively the strength and weakness of the African Human rights system. The lack of real sovereignty in the past and tribal definitions of sovereignty and human beings, are serious obstacles to the efficient functioning of the African continent’s judicial system for the protection of human rights.
