ظرفیت‌های حقوق عمومی در حمایت از پژوهش‌های علمی دانشگاهی

برای سامان دادن به اصالت و صحت آثار علمی و پژوهشی، قانون موضوع این مقاله در سال 1396 به تصویب رسید. این قانون هم عمل را جرم دانسته و هم واکنش‌های حقوق اداری، انتظامی و انضباطی برای جلوگیری از تقلب و فساد ناشی از آن مقرر کرده است. تهیه، عرضه و واگذاری آثار علمی تقلبی به قصد انتفاع و با هدف واگذاری به غیر برای اینکه او برای خود استفاده کند، موید این امر است که میان تولید آثار تقلبی و استفاده از آن باید فرق نهاد. ازاین‌رو مقنن در مرحله تولید اثر تقلبی، رویکرد سزادهی و مجازات دارد و در فرض استفاده، راهکارهای حقوق اداری، انضباطی و انتظامی را ترجیح داده است. مورد اخیر، اولویت را به مراجع اداری و انتظامی یا انضباطی دانشگاه‌ها و موسسات آموزش عالی می‌دهد. تلاش مقنن برای گسترش فرهنگ رعایت حقوق مالکیت فکری و بستن روزنه‌های «فساد» و «تقلب» به کمک مجموعه‌ای از ابزارهای حقوق عمومی، ستودنی است.

The Capacities of Public Law for Supporting Academic Research

The law being discussed in this paper was passed in 2017 in order to regulate the authenticity and accuracy of research works. This law both criminalizes fraud in research works, and sets administrative and disciplinary responses to prevent such fraud. Preparation, supplying, and transferring fraudulent research works for profit, and with the aim of transferring them to others for their own use, shows that a distinction must be made between the production of fraudulent research works and their use. Therefore, the legislator has a punitive and criminallaw approach to producing fraudulent research works while it prefers administrative and disciplinary solutions to using such works. The latter approach prioritizes intervention by administrative and/or disciplinary authorities at universities and higher education institutions. However, legislature’s efforts to spread a culture of respect for intellectual property rights, and to prevent fraud through publiclaw tools are much more desirable.
