الزامات حقوقی اقتصاد مقاومتی در«مرحله قانونگذاری» با تاکید بر اصل 44 قانون اساسی

اقتصاد مقاومتی به‌عنوان راهبردی بنیادی در جهت تغییر ریل‏گذاری حرکت اقتصادی کشور توسط رهبر معظم انقلاب ابلاغ شده است. اعمال تحریم‌های ظالمانۀ یکجانبۀ غیرقانونی نظام سلطه به‌منظور وارد آوردن فشار به انقلاب اسلامی که محدودیت‌هایی برای توسعۀ اقتصادی کشور ایجاد کرده است، از یک‌سو و لزوم به‌هم‌پیوستگی و رابطۀ سیاست‌های کلی اقتصاد مقاومتی با حوزه‌های تخصصی حقوق عمومی در راستای تحقق رشد و عدالت اجتماعی و اقتصادی، ایجاد رفاه و پویایی مبتنی بر تولید و اشتغال و اتکای ملی از سوی دیگر، ضرورت بررسی الزامات حقوقی اقتصاد مقاومتی را مبرهن می‌نماید. سوال تحقیق این است که الزامات حقوقی اقتصاد مقاومتی در مرحله قانونگذاری با تاکید بر اصل44 قانون اساسی چیست؟ در پاسخ به این پرسش، یافتۀ تحقیق که به‌صورت توصیفیتحلیلی انجام گرفته، بیانگر آن است که الزامات حقوقی اقتصاد مقاومتی در مرحله قانونگذاری، تصویب قوانین موثر، شفاف، منسجم و منقح است که کارامدی لازم را به‌منظور عدم اجرای سلیقه‌ای قوانین و نیز بستن منافذ رانت و فساد و تبعیض داشته باشد و با فرهنگ‌سازی در سطوح عمومی از یک طرف و استفاده از تجربیات موفق دنیا و بومی‌سازی آنها در کنار عزم ملی بین مسئولان و مردم از طرف دیگر بتواند به‌عنوان راهکاری مهم برای اجرای اقتصاد مقاومتی با رویکرد الزامات حقوقی به‌کار گرفته شود.

Legal Requirements of the Resistive Economy in the Legislative Phase with the emphasis on Principle 44 of the Constitution

The resistive economy has been noticed as a fundamental strategy to change the economy movement of the country by the Supreme Leader of the Revolution. Imposing unlawful unilateral sanctions in order to put pressure on the Islamic Revolution which has imposed restrictions on the country’s economic development, on the one hand, and the necessity to integrate and relationship between the general policies of the resistive economy and the specialized areas of public law in order to achieve social and economic growth and justice, welfare and dynamism based on production and employment on the other hand, clarify the necessity of investigating the legal requirements of the resistive economy. The research question is that what are the legal requirements of the legislative phase of resistive economy? In answer to this question, the research findings, which have been done in a descriptiveanalytical manner, indicate that the legal requirements of the resistive economy in the legislative phase are the adoption of effective, transparent, coherent and revised laws that make the necessary efficiency in order to enable the creation of public relations between the authorities and the public as a key solution for the implementation of a resistive economy and legal requirements.
