مفهوم همبستگی بین‌المللی و تاثیر آن بر ساختار حقوق بین‌الملل نوین

تکامل حقوق بین‌الملل موجب گذار از دوران همزیستی و در نتیجه آغاز عصر همکاری میان واحدهای دولتی مستقل شد، اما از نیمۀ دوم قرن بیستم به‌تدریج مفهومی جدید در برخی اسناد حقوق بین‌الملل پدیدار شد که به جامعۀ بشری و حقوق بین‌الملل از زاویه‌ای دیگر می‌نگرد و تمرکز خود را بر اولویت ارزش‌ها و منافع مشترک قرار داده است. بررسی قواعد حقوقی و اسناد بین‌المللی نوین نشان‌‌دهندۀ تاثیرپذیری آنها از اصل همبستگی بین‌المللی است، به‌گونه‌ای که می‌توان ادعا کرد حقوق بین‌الملل نوین در حال عبور از مرحلۀ دولت‌محوری و پا نهادن به عرصه دیگری است که ناظر بر جامعۀ بین‌المللی در کلِ آن است. تحدید پیش‌روندۀ حاکمیت‌ دولت‌ها به نفع مصالح جامعۀ بشری تحت تاثیر اصل همبستگی در نهایت می‌تواند موجبات تحول ساختاری در نظام حقوقی بین‌المللی را به‌منظور اولویت دادن به منافع و ارزش‌های عالی جامعۀ بین‌المللی فراهم آورد و آن را به واقعیتی عینی تبدیل کند.

The Concept of International Solidarity and its Impact on the Structure of Modern International Law

The evolution of international law led to the transition from coexistence to cooperation among independent States, but since the second half of the 20th century, a new concept emerged in some international law documents which regard international community and international law from different angle, focusing on priority of common interests and values. The study of legal rules and new international documents reflect their impact by the principle of international solidarity, such that it may be contended that the modern international law is passing through the Statecentered stage to another arena, viewing the international community as a whole. The limitation of the States sovereignty in favor of the interests of the international community as a whole, including all human beings, due to the principle of solidarity, can ultimately lead to a structural transformation in the international legal system in order to prioritize the interests and values of the international community and make it objective reality.
