موانع و چالش‌های اعمال مسئولیت مدنی دولت در ایران

نظریه مسئولیت مدنی دولت از مولودات مردم‌سالاری در عصر مدرن است که در قرن نوزدهم مطرح شد و در قرن بیستم مورد پذیرش کشورهای زیادی قرار گرفت. در نوشتار حاضر با استفاده از روش تحقیق توصیفی – تحلیلی، به واکاوی و تحلیلموانع و چالش‌های تاسیسِ حقوقیِ مسئولیت مدنی دولت در چارچوب تبصرۀ یک ماده 10 قانون تشکیلات و آیین دادرسی دیوان عدالت اداری پرداخته شده است. اجمال نتیجه‌گیریِ تحقیق این است که چالش اصلی در سه سطح «باورِ نظریِ منظومۀ قوۀ قضاییه»، «مصوبات قانونی» و «نحیف بودن دکترین حقوق عمومی در ایران نسبت به مسئولیت مدنی دولت به‌عنوان یک تاسیس حقوقی» است. در نتیجه، شهروندان ناگزیرند برای تعیین میزان خسارت به دادگاه‌های دادگستری مراجعه کنند. این وضعیت، شاهد بارزی بر شکست ایدۀ مسئولیت مدنی دولت است.

Obstacles and Challenges in Applying Civil Liability of Government in Iran

The theory of civil liability of government is from the generators of democracy in the modern age which was raised in the nineteenth and twentieth century, many countries were accepted. In the paper, it has been analyzed the obstacles and challenges to the legal institution of government civil liability in the context of note 1 of article 10 of the Act on the Establishment and Procedure of the Administrative Justice Court, by using descriptiveanalytical method. Briefly, the conclusion is that the main challenge is at three levels: theoretical belief in the system of the Judiciary, legal acts and the weakness of the doctrine of public law in Iran about the government civil liability as a legal institution. As a result, citizens have to go to general courts to determine the amount of damages. This situation is a clear indication of the failure of the idea of ​​civil liability of government.
