خشونت خانگی علیه زنان دارای معلولیت و دسترسی به عدالت در نظام بین‌المللی حقوق بشر

زنان دارای معلولیت، به‌واسطۀ دو خصیصۀ زن بودن و داشتن معلولیت، موضوع تبعیض مضاعف بوده، و در مقابل انواع خشونت و بی‌عدالتی، نسبت به دیگران آسیب‌پذیر‌ترند. محدود شدن آنان به محیط زندگی‌، اعم از خانه یا مراکز نگهداری از یک سو، و فقدان مهارت‌ها و آموزش‌های لازم برای شناخت و مقابله با موقعیت‌های خطرناک از سوی دیگر، آنان را در معرض خشونت‌های خانگی متعدد، طولانی و متفاوتی از سایرین قرار می‌دهد. دسترسی به عدالت راهکار قانونی مقابله با خشونت است، اما زنان دارای معلولیت به‌واسطۀ موانع متعدد، اغلب از دریافت جبران‌های مناسب باز‌می‌مانند. تلاش‌های بین‌المللی برای ارائۀ راهکار‌های مقابله با خشونت خانگی و دسترسی به عدالت برای زنان دارای معلولیت، مانند تامین مهارت‌آموزی، وا‌داشتن دولت‌ها به تامین دسترسی، اصلاح قوانین و افزایش آگاهی عمومی، موضوع نوشتار حاضر است. در واقع، این مقاله در پی آن است تا ضمن مطالعۀ تحلیلیتوصیفی، به رویکرد و راهکار‌های نظام بین‌المللی حقوق بشر در پیشگیری از خشونت خانگی علیه زنان دارای معلولیت، و در فرض بروز خشونت، تسهیل دسترسی آنها به عدالت بپردازد.

Domestic Violence against Women with Disabilities and Their Access to Justice in International Law

Women with disabilities, due to the two features of being a woman and having a disability, are subject to double discrimination and are more vulnerable to all types of violence and injustice. Confinement of women with disabilities to their living environment, whether home or residential centers, on the one hand, and the lack of skills and training needed to identify and deal with dangerous situations, on the other hand, would expose them to multiple, prolonged, and different types of domestic violence. Access to justice is the legal remedy for violence, but women with disabilities are often reluctant to receive appropriate compensation due to multiple barriers. International efforts to address domestic violence and access to justice for women with disabilities, such as providing training materials, making governments provide accessibility, reforming the law, and public awareness raising, would be be considered in this paper. In fact, the present article seeks to provide an analyticaldescriptive study of the approach and solutions of the international human rights law in preventing domestic violence against women with disabilities, and in case of violence, to facilitate their access to justice.
