چالش‌های حقوقی شیوه‌های رسیدگی جمعی دعاوی حقوق بشری در دیوان اروپایی حقوق بشر

موارد نقض حقوق بشر عمدتاً تعداد کثیری از قربانیان را در برمی‌گیرد که اغلب آسیب‌های مشابهی بر آنها تحمیل شده است. این مسئله دیوان اروپایی حقوق بشر را با مسئلۀ دعاوی تکراری و افزایش بیش از حد زمان دادرسی مواجه ساخته است. استفاده از شیوه‌های رسیدگی آزمایشی و گروهی، راهکاری است که دیوان به‌منظور تضمین سرعت دادرسی به توسعۀ آن پرداخته است. هدف اصلی این مقاله نیز بررسی این دو شیوۀ رسیدگی در موارد نقض حقوق بشر و رویۀ قضایی موجود در خصوص آنهاست. در انتها مشخص خواهد شد که این دو شیوۀ رسیدگی امکان رسیدگی سریع و موثر را برای دیوان فراهم می‌آورند، اما شیوۀ استفادۀ دیوان اروپایی حقوق بشر از آنها و ابهامات موجود در خصوص شیوۀ اعمال آنها، موجبات نقض حقوق افراد در اقامۀ دعوا را فراهم آورده است.

The Legal Challenges of Collective Proceedings to Human Rights Claims in the European Court of Human Rights

Human rights violations include a large number of victims, often with similar injuries. This issue concerns the European Court of Human Rights with the issue of repetitive applications and excessive length of proceedings. The use of PilotJudgment Procedure and Class Action are solutions that the Court has been taken to ensure the speed of the trial. The main purpose of this paper is to examine these two methods of dealing with human rights violations and existing judicial procedures concerning them. Finally, it will be determined that these two methods of treatment will allow the Court to have a quick and effective hearing, but the manner in which the European Court of Human Rights uses them and the ambiguities regarding in way they are applied, violate the right of individual petition.
