واژه دولت به مفهوم یکی از قوای سه‌گانه در قانون اساسی

تعدد معانی حقیقی یک لفظ را در علم منطق و اصول مشترک لفظی گویند که در مقابل مشترک معنوی از آن یاد می‌شود. در قانون اساسی برخی کلید‌واژگان از حیث لفظ مشترک‌اند و از حیث معنا و مفهوم، معانی متعددی را در بر‌می‌گیرند. فهم معنا و مفهوم دقیق واژگان مذکور برای جلوگیری از لوث مسئولیت‌ها و ممانعت از تداخل وظایف و کارکردها و موازی‌کاری نهادها به‌نحوی که به اتلاف سرمایه‌ها و ایجاد چالش‌های حقوقی منجر شود، مهم و ضروری است. بر‌ این اساس در این مقاله مفهوم دانشواژه دولت در قانون اساسی بررسی و از مجموع چهار دسته معانی دولت در این قانون به بررسی یک دسته از معنای آن اکتفا شده است. در این دسته از معانی دولت مفاهیم قوه مجریه خاص و قوه مجریه عام قابل مشاهده است. روش به‌کاررفته در این مقاله برای پاسخ به پرسش اصلی این پژوهش در خصوص مفهوم دولت در قانون اساسی به‌صورت تحلیلی است. در مفهوم‌شناسی واژه دولت در قانون اساسی، فرضیه این پژوهش آن است که دانشواژه «دولت» در 8 اصل به معنای قوه مجریه به‌کار رفته است. لکن تمام نهادهای زیرمجموعه قوه مجریه به معنای اعم را در برنمی‌گیرد. مطالعات صورت‌گرفته نشان می­دهد دولت در اصول 29، 43، 44، 147، 151 و 170 به معنای عام و در اصول 52، 80 به معنای خاص است.

The Implication of the Term Government as One of the Three Powers in the Constitution

In logic, the actual polysemy of a term is referred to as homonym, as opposed to heteronym. Some keywords in the Constitution have multiple meanings in terms of homonymity and word meaning. Understanding the precise meaning of the words is critical in preventing the diffusion of responsibility, the overlap of tasks and functions, and parallel work in institutions so that capital is not wasted and legal challenges are avoided. In this regard, this study examined the term government in the Constitution, and one of four categories of the meanings of government was selected for the study. Executive power in a general sense and executive power in a specific sense can be seen in the selected category. This study used an analytical method to answer the research question regarding the concept of government in the Constitution. The study hypothesis in the lexicology of the term government in the Constitution was that the term government implies executive power in 8 principles. However, it does not include all of the executive power’s subinstitutions in a general sense. According to research, the term government has a general meaning in principles 29, 43, 44, 147, 151, and 170, and a specific meaning in principles  52 and 80.
