ابعاد حقوقی حمایت دیپلماتیک بریتانیا از نازنین زاغری

حق دولت‌ها در حمایت دیپلماتیک از اتباع خود که در دیگر کشورها آسیب دیده‌اند، به شرط احراز تابعیت و طی طریق مراجع داخلی و ارتکاب فعل متخلفانه بین‌المللی، مسلم است. لیکن، امکان حمایت دیپلماتیک از دارندگان تابعیت مضاعف در کشور متبوع دیگر شخص و استناد به نقض حقوق بشر شخص حمایت‌شده از مسائلی است که در رویه‌های بین‌المللی در مسیر تثبیت قرار دارد. بازداشت و محکومیت خانم نازنین زاغری تبعه ایرانی انگلیسی در ایران و اعمال حمایت دیپلماتیک بریتانیا از وی و احتمال اقامۀ دعوا در دیوان بین‌المللی دادگستری، دوباره موضوع قاعدۀ تابعیت غالب شخص حمایت‌شده و استناد به حقوق بشر را، به‌عنوان مبنای حمایت دیپلماتیک، مطرح کرده است. در این پژوهش، که به روش توصیفی تحلیلی انجام‌ گرفته، ادله توجیهی دولت بریتانیا در اعمال حمایت دیپلماتیک از خانم زاغری بر مبنای تابعیت غالب و حقوق بشر بررسی شده و به استناد مقررات داخلی تابعیت و منع سوءاستفاده از حق و استاپل مورد نقد قرار گرفته است. همچنین، مذاکرات سیاسی با بریتانیا به‌منظور حل موضوع یا خروج ایران از پروتکل پذیرش اجباری صلاحیت دیوان بین‌المللی دادگستری منضم به کنوانسیون روابط کنسولی پیش از طرح دعوا در دیوان بین‌المللی دادگستری، پیشنهاد می‌شود.

Legal Aspects of UK Diplomatic Protection of Nazanin Zaghari

State right to exert diplomatic protection of its nationals, who have been harmed in other countries, is an incontestable subject matter, provided that they prove their nationality, exhaustion of local remedies, and commit internationally wrongful acts. However, the possibility of diplomatic protection of those with dual nationality in other subject country and resort to human rights of the protected individual is among issues that have been wellestablished in international practice. Detention, trial, and condemnation of Mrs. Nazanin Zaghari, an IranianBritish Subject, in Iran and UK diplomatic protection of her, and the probability of UK litigation in ICJ once again raised the question of dominant nationality of protected individual and resort to human rights as a basis for diplomatic protection. In this survey, conducted by a descriptiveanalytical method, Britain justifications for diplomatic protection of Mrs. Zaghari on the basis of dominant nationality and human rights have been investigated and it has been criticized based on national regulations of Iran in the context of nationality and the principle of prohibition of abuse of rights and estoppel. Additionally, political negotiations with Britain to solve the dispute or Iran withdrawal from the protocol on compulsory admission of ICJ jurisdiction annexed to Vienna Convention on Consular Relations before filing a lawsuit before ICJ can be considered as possible solutions.
