بنیادها و مولفه‌های سازنده جامعه بسامان سیاسیحقوقی در بستر حقوق عمومی

کاوش در طراحی نظام سیاسی و حقوقی بسامان، همواره محور تلاش‌های فکری و عملی اندیشمندان در طول تاریخ زندگی بشر جهت صیانت از کرامت انسانی، حق‌های بشری، برقراری عدالت، نظم، صلح، امنیت و سعادت بوده است. هدف اساسی مقاله تحلیل بنیادها و مولفه‌های سازنده جامعه بسامان سیاسیحقوقی با نگرش مذکور است. با تلفیق داده‌ها در حوزه فلسفه اخلاق، فلسفه سیاسی، علم حقوق و بهره‌مندی از روش توصیفیتحلیلی، به نقش اخلاق وظیفه‌گرا (رویکرد ارزشی)، اندیشه دولت بی‌طرف (رویکرد رویه‌ای) و اندیشه مردم‌سالاری (رویکرد ساختاری) در تحقق این آرمان‌شهر پرداخته شده است. یافته‌ها و نتایج پژوهش نشان می‌دهد که اخلاق وظیفه‌گرایی با تولید انگیزه و رفتارهای منبعث از عقل عملی و قانون الزامی، ضروری و خدشه‌ناپذیر و احترام و عمل به وظیفه و تکلیف انسانی، موجب رفتارهای متحدالشکل، همسو و بی‌طرفانه در شهروندان و حاکمان می‌شود و بروز و ظهور آن در پرتو رویه بی‌طرفی دولت و سازوکارهای دموکراتیک، می‌تواند یکی از بهترین نظام‌های ارزشی، اخلاقی و حقوقی برای تضمین حق و عدالت در نظام سیاسیحقوقی و زمامداری مطلوب تلقی شود. با طراحی چنین الگویی برای مدیریت زندگی اجتماعی و سیاسی، بی‌شک جامعه بسامان یا آرمان‌شهر سیاسیحقوقی در حوزه حقوق بشر و حقوق عمومی شکل می‌گیرد.

Foundations and Constituent Ingredients of the Legal and Political WellOrganized Society in the Context of Public Law

To protect human dignity, human rights, maintenance of justice, order, peace, security and salvation, seeking the design of a legal and political wellorganized society has been always the axis of the intellectual and practical efforts of thinkers throughout the course of history. The main purpose of the current research is analysis of the foundations and constituent ingredients of legalpolitical utopia regarding the previously mentioned approach. Synthesizing data in the field of the philosophy of ethics, politics, law and utilizing a descriptiveanalytic method, article has addressed the role of the deontological ethics, neutral State approach and democracy (structural approach) in realization of the Utopia. By producing the motivations and behaviors emanating from the practical rationality and binding law, essential deontological ethics initiates unified, harmonious and neutral treatments among the citizens and governors. Subsequently, the manifestation of such State, specifically in light of the neutral State approach and democratic mechanisms, can be harbinger of the world politically, legally, ethically best system for guaranteeing right and justice in utile governing. By designing such a paradigm for managing the sociopolitical life, the legalpolitical Utopia in the field of human rights and public law undoubtedly would be crystallized.
