جایگاه «توسعه پایدار» در حقوق بین‌الملل با تاکید بر رویه دولت‌ها

«توسعه پایدار» در عرصه بین‌المللی به گفتمانی رایج بدل شده و با تصویب اهداف توسعه پایدار در اجلاس سران ملل متحد در سال 2015 به برنامه‌ای فراگیر و مورد اهتمام دولت‌ها در ابعاد گوناگون تبدیل شده است. عملکرد دولت‌های جهان در مواجهه با این موضوع در دهه‌های اخیر سیر جالبی داشته است. توسعه پایدار در سیاست و حقوق بین‌الملل جایگاه مشخصی یافته است، هرچند هنوز پرسش‌ها و ابهاماتی نیز وجود دارد. هدف این مقاله تحلیل این موضوع از منظر حقوق بین‌الملل و تبیین جایگاه فعلی توسعه پایدار در حقوق بین‌الملل با توجه به عملکرد دولت‌هاست. در این مقاله سعی داریم با روش تحلیلیتوصیفی این فرضیه را اثبات کنیم که توسعه پایدار امروز از حد یک مفهوم صرف عبور کرده و در جنبه‌هایی به حوزه حقوق نرم بین‌الملل و حتی در بعضی موارد به حقوق سخت وارد شده است.

Position of Sustainable Development in International Law with emphasis on States Practice

Sustainable development has become a widespread discourse at the international level, and with the adoption of the Sustainable Development Goals at the UN Summit in 2015, it has become a comprehensive program at the State level in different dimensions. The operation of the world’s States dealing with this issue has been an interesting development in recent decades. Sustainable development in international politics and law has gained some importance, although questions and ambiguities remain. The purpose of this article is to present current position of sustainable development in international law concerning the function of States. In this paper, we try to demonstrate through the descriptive, analytical approach that sustainable development today has gone beyond the mere concept and entered into some aspects of soft international law and in some cases even difficult law.
