مخاصمه مسلحانه عراق؛ تحلیل اقدامات ارتکابی داعش از منظر حقوق بین‌الملل بشردوستانه و حقوق بین‌الملل کیفری

در سال‌های اخیر جامعه بین‌الملل شاهد ظهور بازیگری غیردولتی به نام «داعش» بوده‌ که با اقدامات خود تهدیدی جهانی و بی‌سابقه برای صلح و امنیت بین‌المللی ایجاد کرده است. تصرف مناطق عمدتاً شمالی عراق، داعش را وارد مخاصمه مسلحانه با ارتش عراق کرد. محور اصلی و اساسی در مخاصمه مسلحانه –خواه بین‌المللی یا غیربین‌المللی رعایت مقررات حقوق بین‌الملل بشردوستانه از جمله اصول بنیادینی همچون تفکیک و تناسب است. پژوهش حاضر با هدف امکان‌سنجی و تبیین قابلیت اعمال مقررات حقوق بین‌الملل بشردوستانه و حقوق بین‌الملل کیفری بر اقدامات ارتکابی داعش، به تحلیل و ارزیابی اقدامات داعش در جنگ عراق پرداخته است. یافته‌های این مقاله نشان می‌دهد که اقدامات ارتکابی داعش در ابعاد مختلف، ضمن نقض اصول بنیادین حقوق بین‌الملل بشردوستانه، آستانه لازم برای تعقیب تحت جنایات بین‌المللی نسل‌زدایی، جنایت علیه بشریت و جنایت جنگی را محقق ساخته‌اند.

Armed Conflict in Iraq; analysis of Daesh’s actions from the perspective of International Humanitarian Law and International Criminal Law

In recent years, the international community has witnessed the emergence of a nonstate actress called "Daesh" that it constitutes a global and unprecedented threat to international peace and security. When Daesh occupied areas of northern Iraq, this event triggered an armed conflict between the Iraqi army and the Daesh armed forces. The main focus of armed conflict, whether international or noninternational, is respect for international humanitarian law, including fundamental principles such as the principle of distinction and proportionality. Daesh has contravened numerous international law provisions by its conduct in Iraq. The group has breached several of its IHL obligations as a nonstate actor involved in the conflict occurred in Iraq. According to the findings of this article, it seems that Daesh’s actions in various respects have provided the threshold for pursuing under international crimes of genocide, crimes against humanity and war crimes.
