مقایسۀ کدهای رفتاری اخلاقی شرکت‌های چندملیتی در حقوق بین‌الملل و حقوق اسلامی

با پررنگ شدن مفاهیم حقوق بشری در نیمۀ دوم قرن بیستم و تاکید بیشتر بر ارزش‌های اجتماعی، اخلاقی، زیست‌محیطی، اقتصادی و بشردوستانه که در کانون توجه جهانی قرار می‌گیرند، مفاهیم جدیدی خلق می‌شوند که شرکت‌های چندملیتی به‌واسطۀ نقش بی‌بدیل خود در تجارت جهانی از آن برکنار نمی‌مانند؛ کدهای رفتاری اخلاقی یکی از این مفاهیم به‌شمار می‌رود. از سوی دیگر، فقه و حقوق اسلامی نیز در خصوص معاملات و تجارت بین‌الملل از همان قواعد ناظر بر حقوق خصوصی افراد تبعیت می‌کند که حقوق بشر را در بر گرفته و در تعامل با شرکت‌ها قابل بررسی است. این مقاله بر آن است با روش توصیفی تحلیلی، جایگاه کدهای اخلاقی و اصول رفتاری را در حقوق بین‌الملل در خصوص شرکت‌ها و حقوق اسلام در سه حوزۀ حقوق بشر، حقوق کار و حقوق زیست‌محیطی ارزیابی کند و نشان ‌دهد که حقوق اسلام و حقوق بین‌الملل معاصر در بحث حقوق بشر به‌عنوان اساس کدهای رفتاری و اخلاقی شرکت‌ها وجه اشتراک دارند.

A Comparison between Codes of ConductsEthics of Multinational Companies in International Law and Islamic Law

Promotion of human rights concepts in the second half of twentieth century and increasing stress on social, ethical, environmental and humanitarian values under global focus, new concepts are established and multinational companies are not exempted because of their unique role in international trade. Codes of conductsethics are one of these concepts. On the other, hand Islamic jurisprudence and law on international trade and transactions is based on the same rules governing private law which encompass human rights and can be studied when dealing with companies. This article endeavors to assess the status of codes of ethics and principles of conducts in international law concerning companies and Islamic law in three areas of human rights, labor law and environment law and to show that Islamic Law and contemporary international law have common elements in human rights as the basis of codes of conduct and ethics for companies.
