چکیده
|
«کمیسیون فرعی جلوگیری از تبعیض و حمایت از اقلیت ها» اصلی ترین نهاد فرعی کمیسیون حقوق بشر بود که آن را در انجام وظایفش در ترویج و حمایت از حقوق بشر یاری می نمود. این کمیسیون فرعی پس از مدتی به« کمیسیون فرعی ترویج و حمایت از حقوق بشر» تغییر نام داد. کارکرد اصلی کمیسیون فرعی انجام مطالعات و ارائۀ توصیه در خصوص مسائل مختلف حقوق بشر به کمیسیون حقوق بشر بود. پس از انحلال کمیسیون حقوق بشر و جایگزینی آن با شورای حقوق بشر در سال 2006 این شورا اقدام به ایجاد نهادهای مختلف نمود که برخی از آنها جدید و برخی دیگر به نوعی ادامه نهاد های قبلی محسوب می شدند. بر طبق سند نهادسازی شورای حقوق بشر«کمیتۀ مشورتی» به عنوان نهاد جایگزین «کمیسیون فرعی ترویج وحمایت از حقوق بشر» ایجاد شده و به ارائه مشورت و انجام مطالعه در زمینه های تعیین شده توسط شورا می پردازد. این مقاله به مقایسه نقش و عملکرد این دو نهاد در حمایت و ترویج حقوق بشر و تحقق اهداف سازمان ملل متحد در این خصوص می پردازد.

Comparative Study on the SubCommission on the Promotion and Protection of Human Rights with the Human Rights Council Advisory Committee

Abstract
|
The ’Sub Commission on Prevention of Discrimination and Protection of Minorities’ was the main subsidiary body of “United Nations Commission on Human Rights”. It was principal body within the United Nations system responsible for strengthening the promotion and protection of human rights. The SubCommission renamed to “SubCommission on the Promotion and Protection of Human Rights”. Its main functions were to undertake studies and to make recommendations on human rights issues and to carry out any other functions which may be entrusted to it. After The Human Rights Council replaced by the former United Nations Commission on Human Rights, the Council adopted its "InstitutionBuilding Package" to guide its work and set up its procedures and mechanisms. Among them was the “Advisory Committee”. It has been replaced the former SubCommission on the Promotion and Protection of Human Rights. The Advisory Committee provides the Human Rights Council expertise and advice on human rights issues. This article was designed to compare the two institutions and their functions and role to protect and promote human rights and realization the UN’s goals in the field of human rights.
