تدابیر حقوقی تضمین سلامت مالی احزاب سیاسی

به‌طور کلی، موضوع ارتباط بین قدرت اقتصادی و قدرت سیاسی توجه بسیاری از علمای حقوق و سیاست را به خود جلب کرده است. نگرانی عمده این است که قدرت اقتصادی بتواند به قدرت سیاسی نیز دست یابد و دموکراسی بازیچۀ دست سرمایه‌داران شود. جریان بدون کنترل و نظارت پول و منابع مالی به صحنۀ سیاست و رقابت‌های انتخاباتی می‌تواند به‌طور جدی ارزش‌های کلیدی دموکراسی را به خطر بیندازد. یکی از مجاری ورود این منابع به صحنۀ سیاسی، کمک مالی به احزاب سیاسی از سوی صاحبان ثروت است که هم خطر نفوذ ناروا بر تصمیمات عمومی را مطرح می‌کند و هم اینکه اصل برابری اشخاص را به خطر می‌اندازد. در این مقاله با شیوۀ توصیفی تحلیلی به بررسی تدابیر تضمین‌کنندۀ سلامت مالی احزاب پرداخته شده و معلوم شد که برای نیل به این هدف، تحدید کمک‌های دریافتی احزاب، هزینه‌های انتخاباتی، افشای آن و در نهایت نظارت و گزارش مالی احزاب ضروری است.

Legal measures to ensure the financial health of political parties

In general, the issue of the relationship between economic power and political power has attracted the attention of many scholars of law and politics. The major concern is that political power can also be achieved by economic power and democracy falls to the hands of affiliates of wealth. The uncontrolled flow of money and financial resources into the political arena and electoral competitions can seriously endanger the key values ​​of democracy. One of the channels for the entry of these resources into the political scene is the donation of the wealthy to political parties, which also threatens the perceived influence of public influence on public decisions, and endangers the principle of equality of persons. In this article, a descriptiveanalytical method was used to examine the financial safeguards of parties’ financial interests. It was found that to achieve this goal, the limitation of donations to parities, election costs, disclosure and, finally, financial monitoring and reporting by parties is essential.
