آسیب‌شناسی نظام حقوقی حاکم بر فرایندهای نظارت بر انتخابات مجلس شورای اسلامی در پرتو سیاست‌های کلی انتخابات

در نظام حقوقی ایران «شورای نگهبان» نهاد ناظر بر انتخابات است که بایسته‌های نظارتی این نهاد به‌منظور اعتلای نظام انتخاباتی کشور، نیل به وضعیت مطلوب و تحقق نظام نظارتی عادلانه در سیاست‌های کلی انتخابات، اعلام شده است. بر همین مبنا نوشتار پیش‌رو درصدد است که با روش توصیفی تحلیلی به این پرسش پاسخ دهد که «وضعیت حقوقی حاکم بر فرایندهای نظارت بر انتخابات مجلس شورای اسلامی، تا چه حدی تامین‌کنندۀ مفاد سیاست‌های کلی انتخابات هستند؟» با بررسی سیاست‌های کلی انتخابات، مشخص شد که قوانین حاکم بر نظارت ایرادات و خلاهایی دارد که لازم است با ابتناء بر این سیاست‌ها، وضعیت موجود نظارت بر انتخابات مجلس شورای اسلامی بازنگری و اصلاح شود. در این مقاله با نگاهی آسیب‌شناسانه، تحلیل فرایند نظارتی شورای نگهبان بر پایۀ اصول و معیارهای متخذ از سیاست‌های کلی حاکم بر نظارت بر انتخابات بررسی و باتوجه به نواقص و خلاهای موجود در سازوکارهای نظارتی، پیشنهادهای اصلاحی ارائه می‌شود.

Pathology of the legal system governing the processes of monitoring the elections to the Islamic Consultative Assembly in the light of general election policies

In the legal system of Iran, the "Guardian Council" is an Election Observer Organization that, in the framework of general election policies, the regulatory requirements of this institution have been announced to enhance the electoral system of the country, to achieve the desired status and to achieve a fair monitoring system. The leading text seeks to answer the question with the descriptiveanalytical method: "What is the mechanism of the Guardian Council’s supervisory processes, to what extent do they provide the provisions of general election policies?" By reviewing general policy, it seems that the laws governing supervision There are deficiencies and gaps that need to be reviewed and reformed based on these policies. In this paper, with a pessimistic view of the Guardian Council’s oversight process analysis, based on the principles and criteria derived from the general policies governing election observation, consideration is given to deficiencies and gaps in the monitoring mechanisms.
