اثر جزایر در تحدید حدود مناطق دریایی از دیدگاه رویۀ قضایی بین‌المللی

اختلافات مرزی میان دول در گستره آب‌ها به مانند خشکی متعدد و حساسیت‌برانگیزند. در بیشتر این اختلافات، جزایر حضور دارند و تفاوت نظر در نحوه اثرگذاری آنها بر خط تحدید حدود، مانع از رسیدن دول به توافق می‌گردد. عدم دستیابی به توافق، زمینه تعیین حقوق قابل اِعمال بر موضوع را فراهم کرده و دولت‌ها را به سمت مراجع داوری و قضایی بین‌المللی هدایت می‌کند. مواد کنوانسیون 1982 حقوق دریاها در تبیین قواعد حاکم بر تحدید حدود مناطق دریایی میان دول مقابل یا مجاور معدودند و در زمینۀ نقش جزایر در این فرایند نیز مقرره‌ای وجود ندارد. در عوض، مراجع رسیدگی‌کننده بین‌المللی تلاش کرده‌اند تا حد ممکن این خلا را پر کنند. این مقاله بر آن است تا اثر اعطایی به جزایر در آرای داوری و قضایی بین‌المللی را شناسایی کند و موضع مراجع صادرکننده آرا را به بحث، بررسی و نقد بگذارد. روش این پژوهش با تکیه بر منابع کتابخانه‌ای، توصیفی تحلیلی خواهد بود.

Effects of Islands on the Delimitation of Maritime Zones from the Perspective of international Jurisprudence

Border conflicts between states along the water like the lands are various and controversial. In most of these conflicts islands are present and differences opinion in the way of influence on delimitations would prevent the states to reach an agreement. Not reaching an agreement would provide a background to determine applicable laws on the subject and would lead the states to arbitral and judicial courts. The articles of the Law of the Sea Convention are too few in order to determine the rules which are regulate maritime zone delimitation between opposite or adjacent states. There are also no regulations in terms of the role of islands in this process. Instead, international jurisprudence have tried to fill this gap. This article aims to find the given effect to the islands in international arbitral and judicial Judgments and awards, and discuss and analyze the side taken by these courts and tribunals. The methodology of this research is descriptiveanalytical which was done with the help of library sources
